Van with trailer and digger parked on road!

Hi

As the title suggests, I live on a new housing estate and my next door neighbour brings home a transit van with a trailer and digger attached (hope that makes sense!)

It doesn't really bother me, as I have a drive for my car, but it is an eyesore!

I'm sure when we moved in there was a clause stating you could not park work vans over a certain weight, but I can't find the paperwork at the moment. I like my neighbours, but the other residents in the street are getting really fed up and one of them has started a petition! The neighbour with the van says he is allowed as he received special permission (nobody has seen prove of this).

The neighbours are having a meeting tomorrow and I feel a little stuck in the middle. I like the guy who has the van and he is me next door neighbour so we are quite chatty, but I don't want to fall out with the other neighbours!

What are the legalities of this situation?

Many thanks.

  • Abstain, stay on terms with your friendly neighbour who's just trying to make a living.

If that means falling out with the neighbourhood !!!!! simply because you won't sign their petition then they are best ignored.

If it bothers you that much could you not be visiting your Mum when the meeting is being held?

If the neighbour is such a great mate, why are you even thinking the legal route just yet?

Next time you are chatting, why not try bringing in to the conversation that you've heard some of the neighbours are not happy about his work van and see where it goes from there?

As far as the neighbours go, do you really give a to$$ what they think of your morals in how things should be dealt with?

  • Sounds like a belting neighbourhood you live in:D.... I have an image of Hyancinth *sp* Bucket:D:D

Is it that bad?... Does he come and go all ours? Is there Oil and Diesel everywhere?... Is it parked outside his own place... Safely?

I think as long as he doesnt extract the Urine..I'd stay out of it... Nothing lasts forever the Van trailer and Digger may be gone before you know it and you'll still be on good terms with your neighbours... I'd rather look at a digger than be getting emotional and emotion back with the neighbours.

My neighbours are and have been great... I've had all sorts on the drive and outside over the years... Trucks to Plant & Farm Machinery coming and going all hours and not a word said....
But the key is not to extract the Urine.......

I should add If my neighbours were to have a Petition... I'd turn up with a Bigger Van a Bigger Trailer and Bigger Digger:D

I think this is indicative of the general way things are going nowadays. There was a time when tradesmen kept their vehicles and machinery in a yard. Not anymore, as it costs. The "got to earn a living" argument doesn't wash as these people are just trying to maximise their profits and don't care about their neighbours. The developer of the estate may have put a covenant in the deeds, prohibiting such activities, but its up to the developer (if he's still around) to enforce it. Usually, developers will only enforce whilst they are still trying to sell houses on the estate - as they are also trying to maximise their profits. Hope you are not thinking of putting your house on the market soon.

If the van is taxed, tested and insured I cant see the problem. Even if it has a trailor on it I am sure it will be legal. Cant see what your neighbours can do about it to be honest.

PS, I secretly think it annoys you too but you would rather let your neighbours do all the fighting and stay neutral yourself so you can keep friendly with your neighbour.

The neighbour isn't a great mate, we just have a chat if we see each other.

He is aware that the neighbours are annoyed, they've told him so, hence why he has stated that he's been given permission to park on the road.

You must be rich if you can read minds!!

It doesn't annoy me to the point that I would do anything about it, its an eyesore, wouldn't be so bad if it was just a van, the digger on the trailer is huge and he often has to park over a driveway (not mine) to fit it on the cul-de-sac.

As you are looking the legal route, the only step forward for you at this point is to verify what he tells you.

I think the best thing for me to do is try and stay out of it! The ringleader neighbour is on the otherside of the man with a van, I can see why he gets cross as he often has his driveway blocked. The van man just tells him if he needs to get out of his drive at night, to give him a knock! He is a retired guy with quite alot of time on his hands, but he shouldn't be blocked in on his own drive, by a vehicle that isn't really allowed to be there!

Maybe if he was blocking me in I would be crosser!
