Have you filled-in and sent-off the forms for annulment of the B/O yet?. If not, then this needs to be your top priority.
Remember, it takes time to gather the info to clear-up this mess. Whatever info you request, regardless of who it is from, they will make you wait the maximum number of days before responding. This creates a lot of stress as you can be waiting for up to 28 days before you can proceed.
Keep in contact with the O/R, and make sure to mark each piece of corespondence 'Claim in dispute' as this means it clear you are fighting this. Do not agree to any payment plan with the O/R. If they decide to take you to court, then you may have all the evidence to clear yourself by then.
Will i be able to use the hearing of the IPO for my annulment?
i had a call from the OR the other day in regards to them making me have an IPA, they only disputed my fuel on my new SOA, the thing is now my missus isnt working many hours, (only bring home £35 per week) she bearly pays for her car to get to work, the OR wont take this into concideration she even said my missus can use my car when i get in from work... the thing is my missus leaves for work before i get in as she starts earlier, she drops baby off at her aunties when she goes, and i pick her up on my way home.
they are putting all of the missus's income into the spread sheet but not any of her personal costs, i.e.phone /car, they wont change this, (the missus isnt bankrupt).
The Or wont even allocate enough fuel to me to get to work. i spend 80 per week to get to work minimum plus parking is 30 per month, they will only let me have 250 for fuel max.
she even said that she wished she hadnt let me keep my car as its now causing them problems.... (they know i only break even i have about 120 surplus) theyre just trying to take money even though i have very little spare.
It costs what it costs i work a long way from home. i cant believe this.
The OR is being really un reasonable again.
they said because i wont agree the allocation to fuel they will do an IPO through court....
Ive not filled in the docs for anullment yet because im still unsure if what i have put together is right i dont want to make any mistakes. i was going to try get a solicitor to look at them but they charge a lot of money, (when i win will i get my fees back what i pay?).You'll see most of my posts are between 00:00am and 03:00 am. this is when i sit down to eat my dinner and drink my cuppa.Any betwen these times are from the officeI may get an early night tonight, 00:30amBest set my alarm for work, 06:30 am:eek:0 -
Just for info,
This is what they said about my REVISED SOA
Travelling
Your car is a 2.2 diesel engine and you travel 66 miles per day to and from work (330 miles per week)
Your vehicle should average 40 miles per gallon for the journey done
EH! and a car with 170k on the clock runs as it says in the catalogue 40mpg my bum, they dont run like this brand spanking new, and there is no way on earth you canb get anywhere near this on the motorway at rush hour M1 and M62 at 07:45. think the OR has the same reasoning as the missus! (it says oxo on busses!)
1 gallon of diesel = 4.546 litres at £1.20 per litre = £5.45 per gallon - £5.50 allowed
330 miles / 40 = 8.25 gallons per week @ £5.50 = £45.38 per week = £196.47 per month.
not at all true it costs £80 per week without fail
As I have allowed £258 for petrol and parking (of £30) – I have not amended this figure Cheers
I have also allowed the car maintenance for your car alone - £60 per month for the milage i do it is what i put down and this was diversified.
Prescriptions
Your letter gives an amount of £30 per month for prescriptions, based on the 5 regular prescriptions that you have. I have allowed £10 per month for this as a 3-month pre-payment certificate is available for £28.25. what about my missus, and dentist, and opticians
Pet Expenses – the only expense considered for pets is for food and the maximum is £20 per month for all pets. Cat litter £10per month (indoor cats) food £20 per month, what about vaccinations and vet bills at £16 per visit minimum, fish tank filters £5.00 per month
We cannot consider expenses that you would like to take out – such as boiler cover and life cover what if i die, what if the boiler packs in, gas service is required yearly, i nolonger have emergency income allowed to cover this? You'll see most of my posts are between 00:00am and 03:00 am. this is when i sit down to eat my dinner and drink my cuppa.Any betwen these times are from the officeI may get an early night tonight, 00:30amBest set my alarm for work, 06:30 am:eek:0 -

i have been playing with it since they sent it to me today, and ripped it appart to find this info, it may not be 100% correct but from what i can make out it seems acurate.

you can add essential items but need to be Essential with a capital E
Whatever you put down, there will be a deduction from the allowance for your partners income contributions for an shared bills. ie mine was 420 for mortgage, they allowed 368
because my missus and benefits are 12% of total income then she is responsible for 12% of the bils it says. however it doesnt let you put in her personal expenses.
whats wierd if you have only £100 surplus you dont pay anything
however if you have over i.e. £101 surplus you will pay 50% of it (weird)
the percentage goes up the more that you have spare
however if you have more than £501 surplus income it doesnt calculate it for some reason.
not that i have i was just playing around with it. i imagine the or has different sheets wherever you go buy i'd imagine numbers are similar. You'll see most of my posts are between 00:00am and 03:00 am. this is when i sit down to eat my dinner and drink my cuppa.Any betwen these times are from the officeI may get an early night tonight, 00:30amBest set my alarm for work, 06:30 am:eek:0 -

What make/model is your car?. It may be possible to run it on waste veggie oil (info available on the net). If it can, then that will save you a fortune (but the OR doesn't need to know).
What about registering the cars to the wife's auntie?, if it hasn't got your name on the logbook, then it ain't yours for the OR to consider the value of (and who's to say you don't use auntie-in-law's car for work anyway).
If it does get back to court and by some quirk of fate, you lose, then the Judge will ask you how much you can really pay, at this point you can argue that you can only pay £10 per month, and if the judge agrees, then that is the end of that.Never Knowingly Understood.

I would be very very cautious about taking advice such as this. The OR can and probably does read sites like this. Im sure that they would have no trouble working out who you are from the info you have provided and so it would not be difficult for them to work out if you are being dishonest.
The court when considering an application for annulment can ask the the OR for a report on your cooperation and conduct in making their decision.
having said that there is nothing wrong with negotiating if you genuinely feel that all of your expenses have not been taken into consideration, it is an agreement not an order, but you must not make up expenses that are not real as has been suggestedHi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.
Please note that any views i put forth are not those of my former employer The Insolvency Service and do not constitute professional advice, you should always seek professional advice before entering insolvency proceedings.0 -

Thanks DI
All due respect to patman, he's only trying to help I'd imagine.
I only put the above info on to help others when working out what's allowed. It's different if your single etc or have no kids.
I have already submitted mine and didn't need to be deceptive in any way and wouldn't be, Mine is what it is i dont need to lie nor would it cross my mind.
like i said to the OR, All my cards are on the table.....
Unfortunately I don't dry clean and auntie looks after the baby for free as a favour.
(The cooking oil would be a good money saving tip if you have the time. Cooking oil needs refining because of the glycerine contained in it can block injectors etc. which also costs so it's a no go I'm afraid (for me) if I had a chip shop and loads of methanol and causic soda I'd be on a winner. you can buy a refinery for about 1k or build one for about 200quid but it still costs you for methanol, causic soda and heating the oil..
Some people are now also selling the waste cooking oil as they know what your doing with it.)
My fuel cost is what it costs no less.
Car is a 2.2 vauxhall vector diesel but worth nothing but very reliable. Looked after and serviced regular. I need a car like this for the milage. And boot size.
I'm not jeremy clarkson but I do know about cars. This is one of the best choices for my job. If I sold it I'd get a grand max. Pointless. I'd have to get a prius for 600quid with a trailer. Which is 100% not gonna happen. Getting a family car with a big boot that does 40+ mpg any you can rely on really for under a grand is laughable. You'll see most of my posts are between 00:00am and 03:00 am. this is when i sit down to eat my dinner and drink my cuppa.Any betwen these times are from the officeI may get an early night tonight, 00:30amBest set my alarm for work, 06:30 am:eek:0 -
you could look up the actual MPG of the car you have and send that in to show that it is is not 40 MPGHi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.

Think that's what they've doneDI .Thing is over time they dont do the designed mpg so the day it rolled out of the factory it may have done 40 mpg until it got stuck in traffic.
it is very rare a car from more than 8 years ago actually does anywhere near what it says on the tin, unless you live in a world designed by MC Escher where everything goes down hill. You'll see most of my posts are between 00:00am and 03:00 am. this is when i sit down to eat my dinner and drink my cuppa.Any betwen these times are from the officeI may get an early night tonight, 00:30amBest set my alarm for work, 06:30 am:eek:0 -
Really really need to sort this soon.
Its funny because I saw a different OR Clark the other day and i explained my situation, although he cannot do anything to help, he was indeed shocked to what i told him and he agreed my partners expence should be added to the SOA.
I told him who made me bankrupt and he laughed. (This seems to be the General reaction)
I cant believe this company is still allowed to do business.
He was a very reasonable gentleman, and listened to what i said, even though he couldnt advise me, i felt assured that i wasnt just being parranoid, it seems someone may have tried making an example of me, and in-experience may be the reason behind the results i am experiencing.
It just shows you it is different for everyone and just my luck to get a case like this....You'll see most of my posts are between 00:00am and 03:00 am. this is when i sit down to eat my dinner and drink my cuppa.Any betwen these times are from the officeI may get an early night tonight, 00:30amBest set my alarm for work, 06:30 am:eek:0 -
It has been proved that the makers quoted mpg is way of the real mpg figure as it is obtained in lab conditions.
C?, head over to https://www.vegetablebiodiesel.co.uk. They are a good forum with experts who will advise as to whether you can get away with just using a mix of diesel & waste veggie oil (wvo is basically filtered to remove the bits of food, then left to settle (oil seperates and floats to the top, water sinks to the bottom) it is the lighter coloured stuff at the top that you want). There are plenty of places that have to dispose of waste cooking oil, including transport cafes and staff canteens.
Even if you can run a 50/50 mix, you will drastically reduce your fuel bill.Never Knowingly Understood.
