    Don't forget that when you finally beat them and stick-in your compo claim, that you can charge 'reasonable costs for research', so charge them £50 p/hr for all the time spent writing letters, visiting the OR & CAB and of course, posting on here and reading the replies.


    One piece of advice I will give you, have a shave, a bath & smarten yourself up, it is amazing how much better you will feel.

    they just said well we have to so dont argue basicaly.

    i did also explain that i will take legal action once the dust settles against anyone who had contributed to causing me distress.

    Hi Confused

    I was just reading on another thread about someone that has got a CCJ and it said after court action has been taken that you cannot make a CCA request that you have to make a subject access request instead.

    I was just wondering if the same would apply for bankrupty which could be why they have not answer your CCA request yet.

    Hi there Paris 5000, If this is the case i did post both the same day with payments. £10 and £1

    they have aknowledged receipt however havnt supplied the CCA or Subject Access Request
    You'll see most of my posts are between 00:00am and 03:00 am. this is when i sit down to eat my dinner and drink my cuppa.
    Any betwen these times are from the office
    I may get an early night tonight, 00:30am
    Best set my alarm for work, 06:30 am:eek:

    I glad that you did both they have 40 days for the subject access request and they have to respond to this.

    With regards to the CCA they may not respond to that because they have already taken court action and made you bankrupt however the CCA should be in information that they send you for the subject access request.

    They have sent you letters confirming that they have received your requests so you have proof for the court that you are waiting for the information.

    Problem is the OR is still going ahead with proceedings I.e asking me to attend further interviews to clarify something I said in my first interview?
    They do know I'm awaiting info and do know I contest the claims. I.e am fighting it.

    They are still not so helpful as you'd like them to be even though at the moment it would appear I'm right in what I'm doing.

    Hello confused? - just in and have come straight there[with cup of tea]to see how you are.
    I truly would print out this Thread[check back and exclude anything no-no] and take 2 copies with you; one to have as an aide-memoire, t'other for the OR's file. He/she may not have time/mindset to read it then and there, but you could ask that it goes on file as it lays out everything as you know it, from the heart. I'd insist and take a receipt for it.
    Could all be useful later when you go after those jackals.
    Actually PARIS 5000, I'm something of an old cynic, but my initial response to this was to see OR's request in the opposite light...let's just keep fingers crossed.
    Confused? - is there ANYONE you could have with you that day? Is it allowed?
    - I mean some friend of professional standing, or an experienced Tribunal/Union rep. type. Am doing similar for someone-still am-simply because said person cannot be articulate with officialdom, just freezes up in fear, which comes across very badly indeed.
    I have to say your incredibly calm, measured, forebearing and accurate self-expression is manifest in your posts. The generous hearing you've given some here has astonished me.
    So - what you need is a Dr's certificate to cover i/v day - shouldn't be hard, given the effects you're describing. This will also add weight to your counter claim file.

    These are the times when it's hard to hold on, when you have sudden moments of feeling unsure, undermined, rattled. They tend to strike at end of day, just timed to wreck 'a quiet mind and a peaceful heart', before you toddle to bed.

    Can you try tonight and think 'But I know this and I am prepared - no ambush this time' and we'll all be here tomorrow.

    Take real care - sit comfortably, eat slowly and sensibly, a companionable drink, then shower today's S-H-1-T away[visualise this, it helps]and let yourself drift. Don't skip brekkie either. Can you sit outside for it if it's nice in the morning again? I do, even in the half-dawn. I love stealing a march on the day, hearing the small morning sounds of things.

    Enough lecturing[I am not that hippy-dippy, truly;)]

    Is it unusual to have second interviews? The only thing I would have thought they possibly could be peeved about was something I told them from the very beginning, this was that I paid bills with my overdraft ( which I lived in anyway). And I only did this to protect my family...
