Have you sent the follow up letter account in dispute no CCA received but I am not sure if that applies to you now because they have made you bankrupt.

It shocking that they can make you bankrupt when they have no legal proof of the debt.

Tell me about it, I used to think we had a good legal system. But failiours like this makes me wonder who actually laws are written for. i havnt sent a follow up letter yet. i will do that.

What you need to do is put your joint household bills down ie mortgage/rent, CT, utilities, groceries etc. Your personal bills like clothing and travel. Your full income and your OH contribution to the joint bills not her full wage. Does that make sense?

    Thanks.

My partners full wage goes to joint bills and she and my daughter are dependent on me for everything else. Her wage barely covers car costs so if I took this off then it would be the same. I would still have to pay most of her basic livin costs as we don't get income support or job seekers (she works 7 hours a week) only child tax credit 40 A month and child benefit 80 a month.

Are you trying to say my income is mine an hers is hers so regardless of her living costs I can't pay for them. Because if this is the case then how would she live.

Or are you saying deduct her wage and her personal costs I.e car phone hair cuts etc from the sheet. If so were in the same boat only thing is the figures are lower as her costs almost match her incoming.

I have read this thread from beginning to end, and am s hopping it all gets sorted-out.
I think that when requesting items such as CCAs, they have a maximum of 28 days (not 28 working days) to respond. So you can begin annulment on day 29 as proof of your signature as not been provided.
Also, for HFC did you also request information on all the stuff they have on you (MSE has a general template letter for this)?. If so, then when it arrives go through it and split it down into the info for each loan. That way you can use the evidence regarding the paid-up loan against them.

Am sure the good fellows here will help you out.. but once its all sorted even though it appears you are wrong your story could be insipiration for others to learn from.

Even though you got statue barred or might... its still causing you tons of grief... maybe if you told your story others might not make same mistakes borrowing.

Its 12 days + 2 working days for CCA requests.

I have indeed requested all info from hfo and Lowell, who have not replied. These letters were sent recorded onthe 14th of september

I requested my CCA from Lowell they did not supply in 12 days so I sent the CCA letter account in dispute no CCA received.

I was then sent a letter informing me that they could not find it surprise surprise and that no payment is required because they have now closed the account.

I think that you should send the follow up letter now because you given them more than a enough time to supply you with a CCA. However it is quite rare for a DCA to make you bankrupt so I wondering if they do have some proof however the debt may still be unenforceable.
