    sorry for not updating this week much.

    so here we go.

    tuesday when social services got hold of income support, they basically fobbed her off saying she should claim carers allowance! for interim payments whilst income support is in suspension. WHAT A LOAD OF CROCK i have never heared such a mis guided piece of advice in my entire life.

    the shelter benefits lawyer confirmed that all IS needed to do is establish who is careing fir the children yes a guidline says that the easiest way to do this is ask child benefit BUT IS ONLY A GUIDELINE not LAW OR LEGIS:ATION.
    he put together a letter of complaint to both CHB and IS who would of recieved these today as was posted recorded delivery wednesday/thursday.

    after me speaking with income support on ex partners behalf they did confirm to me the same story they have stuck to these past few weeks, YOU HAVE TO BE IN RECIEPT OF CHILD BENEFITS IN ORDER TO GET PAYMENT FROM US. i said that i have searched vigorously on the internet and cannot find this legislation she said it isnt legislation or law its a strict GUIDELINE we follow, in order to establish lone parent status, this information isnt available to the public only those that work within DWP and JCP offices, i said because of a mere guidline your causing my children hardship and poverty, thousends of people accross the UK are entitled to child benefit you know i have relinquished child benefit on my side so a matter of urgency and NOT being in reciept of child benefit you could award her interim payments. she said no and that they were sticking to their guidlines, so i said ok so what you saying is that she has to be in reciept of child benefit that you websites is wrong the hmrc website is wrong a benefits lawyer is wrong and so is the mp's office she replied yes i then told her i would take it further and inform the press etc.

    yesterday afternoon i took ex over JCP to hand ion the dated letter child benefit sent her on 16th this month who child benefit say the have no record of ever sending her. faxed it to IS got them also to send a cop via internal mail got a reciept for it. they went through what she filled in for her the day she seen the lone parents adviser, wich on the system says she filled in IS,CTC,CHB forms the sent o copy of this check list to income support,

    now this morning IS reckon that they only have record of that there was a fax sent. they should of had the COMPLAINT filled in by benefits lawyer today also, they said would call back, mean while the MP office called said that they had got hold of a manager in the chb who has looked twice and cant find anything on the system for her but was willing for ex to take a printed claim form from the internet and fixed direct to him via mp's office to fastrak her claim to the processing team. so i printed one out filled it in and took over mp's office who then seen the form that was dated by child benefit so she called manager back and explained and he said that must be for me but as explained and he can check i relinuished child benefit and gave new addy details to them before that date i didnt give any details of ex partner to CHB other than we'd split. he was happy to acceot that i relinquished. get home and ex has her call back from IS they are going to pay her YIPEEEEEEEEEEEEEEEEEEEEEEEEEE they say they had a letter and a fax and could pay her. wich letter i dont know only letter i think off is the letter of complaint, someone had a managers boot in the backside i suspect and told pay this woman.

    child tax credit to sort out now and that should be easy peasy to do for her.

    its taken MP,social services,shelter lawyer,myself, to sort this out. onlything i can say is that if anyone out there thats is going through this situation right now get to your MP get to a local benefits adviser like cab or if in wales shelter get the press get everyone you can think of to add pressure on them. you will win!

    thanks for the update! I am glad this has been sorted out now! I bet it was the complaint letter from the benefit lawyer which put the rocket up their a!!e!

    Glad its all sorted casseus, but proves what I said, that they COULD have paid her as soon as you confirmed you had surrendered the CB-though it should never have taken all those people to intervene; they could not have paid IS on anybody's "say-so", not even an MP, unless the law said it was payable, which was indeed the case. Just a shame that people in JCP do not seem to have sufficient training nowadays to know the full rules about entitlement and processing claims. (I know this from my own personal experience) That will never change unless managers do something about it.
