Your very welcome Karl, keep at them, until they give you a decision in your favour, or until they issue you with a final decision which encloses the details with a leaflet of the FOS.

They sent me a leaflet for the FOS so should I bother sending them a letter back?
I came up with:-
Dear Sir/Madam
Please find enclosed a copy of the letter you sent me dated 20-09-2010.
On page 2, it says the PPC is still active on Mr Bolton’s account. Firstly I would like to know who Mr Bolton is and secondly why you’re sending information regarding him to me?
I would also like you to reconsider your decision against denying me my money. In 2007 when I first got a credit card with MBNA I was pressured into getting the Personal Protection Cover by one of your ‘Specialist’ as they wouldn’t take no for an answer and they assured me I would be covered if I were to lose my job, in the following year (July 2008) I left my job and when I called to declare myself not working I was told I wouldn’t be covered because I left on my own terms and the cover only applies to those who are made redundant. I then had to borrow money from my Mum to clear the remaining balance as the PPC was mis-sold to me and deemed worthless.
I received a new card from you and when I called to register it one of your ‘Specialists’ again tried to pressure me into taking PPC. I told him no, several times, as I wasn’t covered last time and I wouldn’t be covered now. The PPC was still applied to my account. You told me I should have noticed it on my statement, which is true but I never check my statements as I have no need to.
If you’re saying the PPC covers me for loss of job then I would like all my payments back from August 2008 to now, 27-09-2010 and I would like you to pay my repayments as I’m still unemployed, struggling for work and money.
If I am not covered then surely you must see the PPC was mis-sold and I am entitled to my money back.

So they have enclosed the FOS leaflet then?
This may change things, but if you feel they overlooked your complaint and did not give you the opportunity to send them further information after the first letter, it may be worth a try, ask that they get back by 14 days, and make them aware if you hear nothing by then you will then continue to make your complaint to the financial ombudsman service (FOS).
(Sometimes they have overturned final decision within good reason).
You could also state that you are aware that the FSA are punishing banks that are rejecting genuine complaints and for not investigating them properly.
And of course Mr Bolton????
They do obviously have a customer of that name that is nothing to do with your account at all, so as you have done its best to make them aware of this.
If you hear nothing by 8 days though, do continue with the FOS.

The FOS got involved and MBNA said they'd pay up. Got a letter on the 21st December saying I'd get a cheque within 28 days, it never turned up. Rang today and apparently they're gona ring me some time. I'll give em a week before calling back.

Hi,
I hope you don't mind me jumping onto this thread, i just wondered if anyone could give me some advice.
I had ppc from 3/2/04 to the end of Oct 04, as you can see from the dates i only had the policy a short while as i realised i wouldn't be covered, hence the cancellation!
I made a claim with MBNA just over a month ago, they have now written back with the following:
In order for us to assess your complaint further please can you provide us with evidence of your pre-existing medical condition at the policy start date 3/2/04 and we will consider this information when making a decision on the outcome of your complaint. A letter from your gp or from a hospital would be sufficient.
Having just spoken to my gp's surgery manager, she advised the 'banks' usually write to the gp for this information, she also said it will cost me £10 to view my record and any letters or copies will also incur a cost. She advised i called MBNA and query this.
Beginning to think for the short time i had the policy it's not worth pursuing this as it's going to cost me time and money to possibly still end up being refused!

You still paid ppi for 8 months, there is the 8% to consider, though without knowing what ppi you paid we cannot work out what the redress would be.
You would only need a copy of the diagnosis of your condition with the date, have you asked what the charge would be for that?.
At the end of the day it is your call, good luck with whatever you decide to do.0
