It is usually the role of the BUYERS solicitor to register the sale and change of owner at the Land Registry. It may not occur until a couple or more weeks later whilst the final fees are calculated and invoice provided.
If the sale is mortgage free and deeds are present these are also passed over at the same time (mortgaged and the lender holds the deeds). If there are no deeds and for older properties this may well be the case it is the entry on the LR document that proves title (although some will dispute that it does but it can be challenged in a court).
i dont know whose solicitor tells the l/registry but my house was mortgage free and i had the deeds in my possession it was a empty property we hadnt lived in it sincs nov 2007 that was when i bought my current home which was paid for with my inheritence

If you think the estate agent bought it and sold it on, then they have not acted in your best interests and as such should be reported to the property ombudsman and the NAEA.
Hope you come to terms with it.
There are too many posts for me to read what everyone else has said but hopefully this makes sense.
    Goodluck
thanks for your support i dont really know who has bought it but i now it was suposed to be the property company the e/agents introduced him to me

I'm the first in the queue to tell people when they're being muppets, don't worry. And you aren't.

Get some sleep. This is only money. I know it's very important, particularly in your personal circumstances, but so is your health. Have a hot bath, and go to bed!

OP, you might want to consider phoning (or getting someobdy else to phone) the EA and Property-buying company, and casually asking to speak to the person named on the LR documents as having purchased your property.

up until today i was totally convinced i had signed everything correctly and i am positive it was the property companies details but i did go to the solicitors on three different occaisions and i know i signed something on each occaision , this is the first property i have sold i had no idea how many forms i was meant to sign, but i would deffinatly have noticed if i was signing for £109k rather than £71k ,i am starting to dought myself, each appointment was quite rushed and when you are told just sign here, just sign there ,they just push papers in front of you and you sign, and the solicitor always had another client,

This sounds more and more like organised fraud. The solicitor seems to be in on it, confusing you with lots of forms and not giving you the time to read them. I hope he gets the book thrown at him for this. I wonder how many more people he has conned this way.
  • just to let everyone know i have an appointment with new solicitor next thursday, and i have recieved forms from land registry to start investigation, i will let you know the outcome, so bye for now

Good Luck Suzanne, I hope you get it sorted, and at least get some answers.
One thing I dont understand, and forgive me for asking, but you say the property was mortgage free, but you only walked away with circa 30k?

yes it was mortgage free and it was first valued in 2009 @£105,000, then with the ressession i agreed reluctantly on e/agents advice to drop the price to £94,950, we had quite a few veiwings, but e/agents still wanted to reduce it further ,but i wanted to wait to see if the h/market got better, then no veiwings till feb 2010,and e/agents still kept telling me to reduce price, then they sent this chap from a property company, i diddnt want to see him really ,and know really wish i hadnt, but i also was curious to see how much he would offer, first offer was in low £60k then he kept upping his offer to £72,500, e/agents adviced me it was a good price!! because of the economy so i reluctantly agreed, then the buyer started messing around dropping offer again down to £60k and i just said no, put it back on the market ,then about 10 days later he started to up his offer again back to £71,500, i accepted reluctantly, on e/advice ,but according to the land registry i sold to someone i dont know and have never met ,for £109,500 ,so going to new solicitors on land registry advice to find out how come my signature i saying i received this £109,500 when in fact i only got £71,500. hope that explains it.
