    HP have referred to their usage instructions and it may be that they are relying on advice within those instructions not to leave the laptop on a fabric surface that will impede the flow of air through the cooling system on the laptop. If you put a laptop on a desk then there is a gap under it between the case and the desk which allows it to draw in air to cool it. If you put it on a carpet or bed etc, then it sinks into the surface so that no fresh air can get under it. At that point it starts to over heat because they all rely on fans cooling the processors. If I have mine on my lap in a certain position I can feel it starting to get hot if my leg is blocking the air intake.

    A possible scenario is that the laptop was overheating at the time you put it into hibernate mode due to it sitting on the carpet. You then left the room and residual heat within the laptop did the damage fairly quickly after you left the room, with the smell taking some time to reach you upstairs. This is the scenario that HP may try to paint to effectively blame you for causing the problem, and its going to be hard to disprove if you left the laptop on the carpet.

    The question therefore is whether you can show that your actions didn't make overheating more likely (very hard if the laptop was on the carpet rather than on a desk), and whether you are likely enough to be able to do that to make it worth going for more than the replacement laptop you were offered. You may be better accepting the laptop from HP and claiming on your insurance for the carpet damage. I'm not trying to be unfair (and its not clear where the laptop was but there is no mention of anything dripping down from a table to the carpet) just trying to offer a suggestion of how HP will try to play this. Sometimes you have to balance the risk of ending up with nothing against the chance of getting more if you keep fighting.

    Did you buy the laptop directly from HP?

    If not, they do not have any liability, it would be the retailer instead.

    Thanks everyone (well aside from the guy who posted first lol)...

    to clarify. It was hibernate, (dont have a std by on this model). I was using it on my lap, but then placed it on the floor.....

    I do understand what u are all saying re getting something rather than risk nothing...i dont have household ins as was made redundant last year (working no but havent had a chance to get the ins again)....

    rented house, not my carpet....u can see where im going...i still feel that the laptop is clearly faulty....shame i cant post the pics on here....or can i?

    Oh and i have the offer etc on email

    I think you placing the laptop on the carpet (thus reducing/blocking the air circulation) caused the problem.
