I can see how it might be possible to be unclear about completion. Many solicitors just don't tell you what's going on/what the process is, etc. They assume you already know.
Bit loony though.... I'd have thought she'd have been checking all along when it was - and - she'd have got a phone call from her solicitor once the funds had arrived.... aka: when it wasn't her house any more. If that were me I'd be like a headless chicken running round saying "OMG OMG OMG" and immediately arranging a van and to be at the house falling over myself apologising....
The OP's seller seemed to have no sense of importance or urgency once advised completion had occurred.0 -

Whilst I'd hope this was rare, I can testify that solicitors don't always keep you informed. My OH was selling her house last year, and got a phone call from her estate agent one day saying she'd exchanged contracts. At no point since she signed the contract did the solicitor contact her to ask for authority or advise it was about to happen!
Had it been completion rather than exchange, this would have left her in a rather tricky position!
I'm sure the situation must be dreadful though if you've just got the keys then find the house is still occupied. Fingers crossed it's all resolved very soon and you can start to enjoy your new home!

Would you chase it though? i mean selling your house is a big thing , its not like your selling old clothes on ebay , its where you live , roof over your head. Surely you would want to know?

If it was me selling I would want to know. Plus the estate agents asked her weeks ago if last Friday would be convenient and she said no Monday would be better. We agreed to that assuming she wanted the weekend to move

Hiya, it is good practise to contact the client before exchange to get their permission, you know just in case they have died or something just as extreme. Also completion dates cannot really be agreed until exchange so this again should be confirmed in that last phone call.

Generally, you sign the contract and leave it with the solicitor to be exchanged once various issues are sorted. This saves another dealy while everyone gets down to their solicitor to sign the contract. The solicitor should not exchange without an instruction which covers itHi, we’ve had to remove your signature. The other side of the coin is that if people are not held accountable for their actions and/or inactions then they never learn and the country starts to go downhill; I think that's happening already in the UK.
The OP's seller is a case in point; firstly wanting to delay moving her stuff until next weekend and when told no still wanting to delay for another day. Whether the seller really knew when completion was is irrelevant, she'd previously agreed to vacant possession but when notified the time was now appears to have had no inclination to honour her obligations. Well done to the OP for standing firm and making it clear her behaviour was not acceptable.Every generation blames the one before...
