I'm sure that 2 legal teams could argue till the cows came home, each convinced they were right, and charge the taxpayer a fortune in the process of deciding the matter.
Even your QC will only have an opinion on it. You would have to test that opinion, presumably in court.
If you wish to waste your time and money by doing that, you belong on a different website. This one is called moneysavingexpert.com, in case you had forgotten.

well im backing barry, not because i know or dont know about ctax law but because of simple common sense. i have never rented a full tenancy (always house shared) before buying properties, i have never been asked to provide my mortgage documents to show when the mortgage started?
and as others have pointed out on here, there is no need for a written tenancy, so what would the council do if this was not a written tenancy.
i would go straight to the manager and then the mp, this is ludicrous and yes, as others have suggested on here, this is exactly about principle. there wont be any liaibility on the actual tenant until the bill arrives in her name, there may be a court orde rfor the person on the bill to pay but as that person doesnt exist, it will be difficult for the council to get their money0 -
