I would say key facts are it's the sellers responcibility.
and it must be fit for purpose which given that the handset is supposed to work for the duration of your contract, i would say it has failed.0 -
Even if you pay for Orange "Care" insurance at £5 a month, they still sting you with £25 admin fee to replace your phone, even if you have the old one.
They said it's in their T&C online and you are expected to go online and check for any updates and amendments. Uh-huh, so you won't actually notify me that you've changed the T&C's I signed up for? Nope seems not.
Hence Bye-bye orange!

I believe Vodafone will replace a faulty phone with a refurbished phone for free, or you can claim an upgrade and possibly pay a fee for a new phone.
Orange notified me that after the 12 months contract, the phone is mine, so not sure if they meant the phone was their's during that time.

The handset does not form part of the contract with your mobile operator and it belongs to you from day one. You can sell it and use an alternative if you want, lots of people do! You can put the SIM card into any compatible unlocked phone.

I see that but Orange seem to be a bunch of monkeys and insist on the 'admin fee'. I suspect they call it that to get round the sales of goods act.
I'm going to try nokia anyway as I suspect it'll be easier to do it that way than brow beat orange.
Edited to say: Just spoke to my local nokia service centre and they've said that I can go through them without incurring ANY charges (even if it has to be sent anyway by courier). So as long as the damage comes under their warranty terms it'll be dandy.
I think I've really learnt something about orange here!
Think I may send them a letter of complaint just so they have it on record how useless I now think they are.0 -

Anybody know if Sony Ericsson warranty repairs are as good as Nokia. Searched for the nearest outlet on their website but it doesn't seem to be working.
I wasn't advised of the £30 admin fee by orange as I gave up after an hour in a queue.0 -
Carphone Warehouse also repair Sony Ericsson handsets as part of the standard 12 month warranty that comes with the phone. If they can't repair it instore they can send the phone to the main repair service centre for free.
This includes phones that haven't been purchased from CPW.0 -
