HAVE THIS AFTERNOON CONTACTED SCOTLAND YARD AND BARNET POLICE. PLUS APPLIED FOR FREEDOM OF INFORMATION ACT AS TO GET THE DETAILS OF THE 'LOAN COMPANY' HALLMARK WAS DEALING WITH US ABOUT OUR LOAN.

ALSO STILL NO RESPONSE FROM HALLMARK REGARDING MY REQUEST FOR THEIR DPA .................THIS IS A CRIMINAL OFFENCE NOT TO HAVE A PROPER ONE. HE DID NOT MENTION THIS AT ALL IN HIS LETTER TODAY !!??????

IN FACT HE NEVER ACKNOWLEDGES ANY QUESTIONS I PUT TO HIM, HE ONLY GETS ON THE DEFENSIVE AND STARTS THREATENING LEGAL STUFF - BUT STILL HIS TYPING IS APPALLING - HAVE YOU ALL NOTICED THIS?

today - we have written to mr burdett etc and requested an SAR - he has to provide details of everything he holds about us on his file - including who the loan was supposed to be from etc. we are sending the £10 that is payable along with proof of id and under the data protection act - he has to provide all this info. if he isnt up to date with his data protection - then that is a criminal offence we have been advised.

all we have ever asked them is who the lender was - which he has all along refused to tell us - any other broker would have been open about this information. why hide it? we are still owed £1155.25 and want a refund.

the views on this hallmark info have gone up alot overnight.

Thanks to all the people who have put up warning flags against this company. I almost got strung along until I thought about searching for information. As you say this company plays on people who are looking for funding which is hard to come by in the current climate. I asked for £30,000 to refinance a leasing agreement and also mentioned that I had opportunity to take on another business which requires refurbishing. He (Simon Davis/Lloyd Green) sent paperwork for both of these deals for £30,000. No wonder having now read these threads. He would presumably have used obfuscation and various other ruses to get the arrangement fee for both and then say we failed.

I was given his details by a friend who had a letter from them. I was suspicious regarding the emails also. I found it slightly perturbing that in this day and age a company like this doesn't have a reasonable website.

we are really pleased this has helped you. this whole thing is growing by the day and the views have shot up so hopefully many more innocent people are going to be saved from this. i have had a reply from scotland yard/met police and they have given me a link so i can send my complaint. they also said to report it on action fraud - see internet for the address.

i have posted the SAR - Subject Access Request this afternoon. if he breaks the law by refusing to comply with this request then the ICO - Information Comm. Office want to know about it. again he will be breaking the law if he does not comply and reply as he has to under the Data Protection Act etc etc.

lets all keep the pressure up and we are looking to get a group sorted to go down and have it out face to face and see exactly what is going on. the police will help us they have said.

this guy is not outside the law of this country and we will not allow him to keep getting away with this.

yes we got all our paperwork back after sustained and continuous pressure for him to do so. our file was about 8inches thick! stacks of bank statements etc just keep requesting it!

hello everyone,

thought i would just update you about what we have done to date.

1. we have reported him/hallmark to the police at barnet.

2. have completed online complaint/fraud form on the actionfraud.org.uk website.

3. have sent off the SAR - (SUBJECT ACCESS REQUEST) - with the £10 fee payable to HALLMARK - so HE HAS to send us ALL information he holds about us - digital and paper copies etc.

FAILURE TO DO SO IS A CRIMINAL OFFENCE UNDER THE DATA PROTECTION ACT. AND NOT EVEN HIM/THEM CAN GET AWAY WITH THAT ONE!

4. spoken to the ICO - INFORMATION COMMISSIONERS OFFICE - see ico.gov.uk - they have assured me that they take an extremely dim view of any company who TRIES to ignores the SAR request as it is a LEGAL REQUIREMENT FOR HALLMARK TO COMPLY - REGARDLESS OF WHO HE THINKS HE IS.

5. there is a perfect template letter for the SAR ON wikipedia - see consumerwiki.co.uk

6. we have also sent an official complaint/report to the BARNET TRADING STANDARDS OFFICE - who have already told us they have been watching this situation for some time. We originally reported him last December/January 2011 - after he point blank refused us our refund after we found him out. we gave him a chance to give us back what he owed us - but he obviously thought he would get away with it - NOT !! We did tell him we would leave no stone unturned and we meant it. he clearly thought he had got rid of us...............more fool him.

WITH THE SAR REQUEST - IT IS THE LAW OF THIS LAND - IT IS A LEGAL REQUIREMENT UNDER THE DATA PROTECTION ACT, (DPA), FOR THE DATA CONTROLLER TO COMPLY WITH THIS REQUEST. THIS IS FROM THE ICO WEBSITE - obviously, he is the data controller - whichever hat he is wearing this WEEK !!:)

as soon as we receive information back from all our complaints - i will update this thread.

LETS KEEP UP THE PRESSURE - DON'T GIVE IN.

KEEP ASKING HIM FOR YOUR FILE TO BE RETURNED - I KEPT ON AND ON AT HIM UNTIL HE SENT IT BACK. I KEPT EMAILING AND HE SENT OUR DETAILS BACK. if he blocks your email, like he did mine - use others etc. keep leaving messages and keep writing to request your file back.

REMEMBER HE HAS IMPORTANT PRIVATE DOCUMENTS LIKE BANK STATEMENTS/ I.D. ETC ABOUT YOU - SO DONT RELAX ABOUT THIS.
