I am now convinced that most and I include myself in this, have caused the failure in the first place. Get it right at the start, and the decision will be right!!! His genuine comments about the ATOS report really surprised me. It just goes to prove that the DWP are human, and I now believe that they are trying to do their best but are hampered by ineffective ESA50's.
People dont pay enough attention to the ESA50 and give nowhere near enough information. If they took the time, and there is a total of six weeks, then they should answer the questions one by one and it gives a DM a lot more scope to give additional points than those given (Or not given) by ATOS.ESAHeadache wrote: »Hi Andy,
It may be the case if the ESA50 form has been completed but what about someone like me I didnt complete a ESA50 form due to my mental health problem which didnt allow me to and also DWP advised that I wouldn't need to send it.
My Rep is gathering information to dispute the ATOS report how could ATOS who don't have any information on how my Mental Health exactly is come to a decision by asking irrelevant questions and look at how I looked and was on the day and give me 0 points?
Im worried now so all the evidence that has been gathered will not be looked at or taken into consideration.
I feel like im going to have a panic attack now thinking about this.0 -

Hi and Fnx,
Spoke to smaritians and they were good but when I were sitting down thinking about everything a panic attack came and I didnt realise I overdosed on escitalopram, zopiclone and co codamol. Its very frustrating i've had to wait all these months just for the tribunal date and now that there abit more than a month left i'm left un-informed. I just don't understand anything anymore there are people with the same condition as me who get esa support and also dla care and mobility.
I read in a few places they look at eveidence of at the time and this stressed me out as i didnt compete esa50 due to mental health and were told not to. so im disputing a report and obvisously the only information they would have has at the time were the sick notes not a full description of how my health effects my day to day life.
So im just worried that they might upheld the DWP decision or put me in WRG which wouldnt help and just push me more to the edge.0 -
That is the absolute truth.

People with mental health conditions do not have to complete the ESA50 and will be called for the medical regardless but where possible the ESA50 should be completed anyway for the reasons I stated above.
Hi,
Yes I do agree with you but the point im stressing is that i've got a tribunal coming up soon how can the tribunal know anything about the time if i dint compete the esa50 and the only information available was the sick notes and a silly ATOS report which the assesor had near enough no knowledge of how it affect me day to day by asking a few silly questions0 -

There is no way in hell a person who suffers mental heath problems can be judged by this medical alone.
The advice with mental health is always get all forms filled in by a 3rd person as the claimants evidence will be disregarded as it can not be trusted.
The 1st question I was asked at my medical Friday was who helped me fill in my ESA50 form!
I got all my forms filled in by a local welfare rights group :T DLA took under 2 weeks from sending in the forms to be awarded
OP approach a local group or dial for advice on DLA and also try and get all forms filled in by somebody other than yourself.
I was asked 5 to 6 question in my ATOS ESA medical and only 1 could be considered related to my condition. Most of the 20 minutes is taken up by 3-4 minute pauses as they type - it can be clearly heard in the recording I took of it
My biggest fear is my DLA is now stopped because of this medical as I'm using it to help pay for low cost psychiatric therapy which I wouldn't get on the NHS for the length I need.
If it gets stopped then my only option would be residential care (which I don't think would be right for me atm) costing the tax payer £2500 a week :eek:0 -
I can't see an answer so will ask again, do you have a CPN/ psychiatrist? Have the hospital discharged you to the care of the Crisis Team?Gone ... or have I?0

The hospital discharged me after seeing a Phsyciatrist nure PLN i think they call them. Told them it happened after a panic attack in relation to all this stress and they advised me to be refered to GP who shall have to forward me to CTRT urgently if condition goes worse. I think anyway can't rememeber much still have dozed coz of all the medicine.0 -

So are you going to go to your GP tomorrow?
People can give support here, but you need to be proactive to sort out your concerns about the Tribunal, and your health.Gone ... or have I?0 -

I shall be hopefully be talking to my GP tomorrow as I said it all just built up and im very thankful for all the people on here's help,
Im just trying to cope I guess this all is a nightmare for me having to be lived over and over0 -
Is it possible to get refered to Citizens Advice Bureau as it would be difficult for me to wait outside their building just to be sent back as they only see the first 10 or so and the rest are sent back0
