Would I be entitile to disability Living Allowance because of my mental health??

Here's a link that sort of tells you all about it http://www.direct.gov.uk/en/disabledpeople/financialsupport/dg_10011925 - I'm claiming based on my physical needs but I did mention my depression and anxiety about leaving the house and about needing someone with at all times to make sure I don't hurt myself - have a read through and request the form be sent to you - it certainly doesn't hurt to apply, does it? There are people on here who will have successfully claimed DLA and they will hopefully be along soon with some advice.

What are the processing time for DLA and also what kind of evidence could support my claim?

This is very informative im glad that you pulled through it and hope your DLA claim is all sorted out for you soon.

My hearing is on the 2nd of september I shall try to do as you said and make a personal statement of some sort shouldnt my representative who is going to make a written submission be noting all this for me as I have problems especially with this horrid mental health to be able to sit down and do all this.

Many thanks for your support (apologies for replying to your posts in the wrong order - these painkillers and anti depressants certainly mess with your mind).

From my personal experience of the tribunal, whilst they do read all the evidence that is sent in they seem to focus (quite rightly, I think) on what YOU have to say (even in writing) as who knows what's wrong better than you. They seem to accept what you say (and write) more than what the ATOS medical report does so be positive.

Apologies for taking so long to get round to this reply - been a bad morning.

I got my letter turning me down within 2 weeks of submitting the forms - again, I filled it in sooooooo completely - but their letter states they base their decision on both my completed form and the ATOS report but I think they just looked at the medical report decision. But I am just getting my appeal letter and statement together to appeal the decision - maybe a DM will overturn the decision but I anticipate another tribunal but at least at that one you get to mention your original condition and how it has worsened and how you see it progressing so quite looking forward (in a weird sort of way) to putting all that forward at the appeal. As for supporting information, you can actually put the contact details of anyone who may care for you so a friend or relative (they can explain about what level of care they offer and explain more about your condition - I think they may write to or telephone your carer or you could put in a signed statement, I suppose) and your GP can put in supporting statements and reports. As I've said before you can never give too much information IMO. Anyway, back to my appeal letter and statement - the DWP must dread anything I send now LOL

I can't imagine that will help in the long run tbh.

Remember there's usually somebody here you can "talk" to - I try to come here as often as I can during the day looking at lots of different forums and threads - makes you feel sort of involved if you know what I mean - you get to share the good, the bad and sometimes the downright ugly - even the most personally irrelevant threads can make you laugh out loud (the motoring one is always good for a giggle) and if you want experiences and advice (as you have found) then there's always somebody who's been there, done that and beat the system. Be well and take care.
