I've only taken into account the circumstances the OP has given us. Anything else would be speculation and I'll leave that to others.

Which takes us back to the speculation I spoke of. All we can do is take the OPs post at face value. Of course, many more people than the OP have viewed this thread, so maybe it has been a help to one of them. DV isn't something a lot of victims are too happy to shout about. But, anyone reading this thread MAY have a better idea of what is, and isn't, available. Would you wish them not to?
i think by the other person by not responding her plan has been rumbled by us and its quite clear for everyone to see she has tried to pull a fast one.
basically she has gone on holiday with her ex husbands two kids without telling him, she obvioulsy had the intention of staying in cornwall and this can be seen from one of her old posts, before she went away on holiday.
She probably got someone to stay at her council house, and this was a relative of her new boyfriend, i suppose what happened was the ex went round and was greeted by one of her new boyfriend relatives who was living in her council house.
I suppose he asked where is kids where and then it went off, no wonder she couldnt show her face, to go and get her stuff.
Now because of all the trouble her ex caused she had to give up the council house, whether the trouble was because of her extended holiday with his two kids 200 miles away i dont know, but i suspect it has got something to do with it.
The person who was looking after her house could not stop there because of the hassle from the ex, what was she expecting? and do you really think the relative was stopping rent free in london?0 -

So, from your own post, we have an assault and threats from an ex partner who's actions cannot be described as "reasonable". That's what she's fleeing from, and that is why her homeless application should have been accepted had the LA applied the legislation correctly. That's all I'm saying.
If, as you say, she is pulling the wool, we end up with her in Cornwall and an available house in Surrey.
If, however, she is being honest (and we have no evidence to suggest otherwise) and we send her home, we could be looking at another sad statistic and a gravestone. Hell of a gamble to take on the basis of your wild guesswork.
I would hope that an agency such as Shelter should be able to get any negative decision overturned on review. They will know the legislation at least as well as the Homeless dept, who are clearly relying on the OPs ignorance to deny her.0 -

she never fled, she went on holiday, and if she was in danger would you leave a relative to face the music?

Why would anyone want to leave sunny Surrey to settle in some backwater? Surely prospects would be better in Surrey? The ex-threat thing strikes me as a red herring for some alterior motive. OP needs to move back in to the real world. And that would be Surrey!!0

Mmm, Surrey (far too expensive, rat race commuter land) compared to sunny, artistic, "English traditions are alive and well", home to beautiful northern beaches, Cornwall..... Surrey doesn't have Crantock. Or Land's End.0 -

I woldn't live in that god forsaken place again if you paid me!
Grew up in Surrey, it was shoite, then this year spent 4 months in a different part, equally shoite.
Now I much prefer living on the south coast!0 -

This is not the bloody wild west, people should not be driven from their towns.
I really don't think that running away from a situation solves anything. Try a little harder to understand what people are trying to say and stop jumping to conclusions!!
If i had a violent ex i would go to the police and ask for protection, i would not buggar off with his children (bound to irritate him further) to the holiday hot spot of the uk and expect to be housed for free.saving up another deposit as we've lost all our equity.

The op was making a claim as homeless though, how the local authority runs its housing register is not relevant. The local authority is Cornwall all the district councils in Cornwall ceased to exist over a year ago, strange that the OP would state she applied as homeless to Kerrier then.
