  • Aren't we all using this site because from time to time we make mistakes with our financies or bad judgement calls? Give the girl a break - we aren't here to fall out amongst ourselves, remember who the real baddies are - the banks, financial institutions. Whilst these "freebies" are nice to take advantage of, someone always pays really, Companies do not give things away out of the kindness of their hearts there is always going to be an ulterior motivea tax dodge or pushing up prices elsewhere to reclaim the loss. There is NO such thing as a free lunch!!!! Stop seeing the company as an injured party!!!!!
  • If the Terms and Conditions is on the website get yourself a print out of it as you don't want them to go and change it and then claim it was always like that. May also want to save the actual webpage. If you mentioned it to any of your friends, tell them to do the same as they might also get the same letters with a bill.

    I'd then send them a letter back saying that your solicitor tried to contact the solicitor that was shown on the letter but they hadn't heard of them and they aren't happy that they are being refferred too (scare them with angry lawyers)

    Also say you would be happy to see them in the small claims court as you conducted business with them within the terms and conditions stated. Send them a copy highlighting the parts of seperate transactions and as many as you like orders.

    You probably won't hear anything else from them.

    If it was me and I was sure I had abided by the Terms and Conditions I'd be cheeky enough to request some chocolate and flowers in return for the distress and inconvience of them sending a bill :)

Right to all of you who have emailed me privately and posted messages on the site, a HUGE thanks for your support, It does appear that we have been rumbled, Oops, the code no longer works, lets hope it teaches valueflora a lesson for the future. I am off on holiday for a few weeks but will keep you informed when I return.... Thank you Thank you Thank you x x x PS I think the people who had a go are just a teenie bit fed up cos they never got free flowers too !

  • There's no point slating the person who used the loophole because if the company had been more stringent in BOTH the ordering and despatch procedures it could have knocked this on the head much earlier. The company has been foolish, but far bigger companies have been equally or more foolish than it. The loophole should never have existed in the first place and the company should be looking at who writes/maintains the website and who allowed it to happen in the first place.

    I was going to post that BargainMad's post made the most sense, but BargainMad then lost all credibility in my view in the later posts on this page.

    The offer (on the page linked earlier in the thread) is very clear that it offers a £22 discount on the item shown. There's nothing at all which says it's available on anything you choose off the site.

    Using the code on things it doesn't apply to is simply fraudulent.

    I don't see any reason why ValueFlora won't be able to pursue this.

  • Are you sure the code was used correctly ? From what I understand the loophole was that you could put the code into an order for a different item and it would deduct the amount to make the order free. I am sure this was the loophole.

    Of course this constitutes misuse but if someone reads on a message board "free flowers and chocolates" by using this code without going into too much detail, there are BOUND to be takers. It seems that there were quite a lot of takers and the company have been very stupid not to have seen this earlier.

    On the legal side of things, the company will have a big problem gaining settlement but that will not prevent them seeking it. Had there been a credit agreement as part of the order process it would have been on strong grounds but there was not. I feel sorry for the company because when they LOOKED at an order they could see 0.00p on the confirmation and yet STILL they kept sending them out. They must also have known that the SPIKE in demand was being caused by something. A look at their revenue account would have alerted them to something being wrong - but they seem to have let this go on and on and on.

    As I say there is no way that this company would have mandated a code that allowed free flowers and chocolates being sent at company expense for a limitless amount of time. It was a loophole caused by the website allowing codes to be applied where they should not have been.
