Ah cool... I think I must have had a 'blip'
I spoke to another creditor today to tell them they wont be getting any more payments, Black Horse... They were very civil and pleasant indeed.0 -

I'm new to the site so I'm probably doing this all wrong, so bare with me please.
I've a slightly similar experience with devious DCA's, myself and the wife have various bad debts being collected at agreed monthly payments of £10 to £50, the agencies are morecroft, fredrickson international & heatons solicitors. I can't say that I've had any particular problem with morecraft but a strange thing happened with Heatons.
Heatons were collecting the monies outstanding on a Halifax BS CCJ which we had been paying of @ a nominal £12/month for a number of years, 3 months ago I phoned Heatons to see what they would settle for if I cleared the outstanding balance of £ 400 in one final payment, the phone went quite as they checked their records, then the answer came back that nothing was owed, the account was clear. I queried this as I new just under £400 was still outstanding, to which they responded that the Halifax had notified them in August 2005 that the account was settled.
I then asked "well whats been happening with the payments, I only sent a cheque 4 days ago" which they acknowledged that they had received and advised that it would have been banked in suspence account, I obviously asked for the money back and all previous payments since the account was cleared.
They advised that they should have notified me that the account was cleared but if I told them the dates and amounts of the cheques in question they would refund the balance, two days later I phoned back with the Chq No's and dates for the eleven cheques in question (which incedently they obviously already new about as they acknowledged that they could see the payments on the computer screen), anyway 3 weeks later they sent a cheque for £132.
As I said I'm new to this and my post doesn't really have anything to do with the original morecroft thugs thread other than I'm convinced that they would have continued to bank the £12 Chq's until the full £ 400 was cleared.
I am interested to see if anybody else has experienced a similar thing
1 A creditor writing off an outstanding balance on a CCJ even though the monthly payments were being met?
2 A DCA continuing to accept payments even though there was no debt to collect?

The fact that they continued taking money from you, plus actually asking you to send proof of what they would already have had on their screen, reinforces the whole point of this thread - I bet they didn't give you any interest on that refund:mad: :mad: :mad:I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Before going into the debt collection department I was an underwriter - I made the step up without too many problems.0 -

I had been a senior underwriter for many many years, Underwriting and collections go hand in hand, yet still I cant see your view on things.0 -

Sorry I didn't make myself clear they did pressurise me this of course was made even worse because of my medical condition - they have been reported.
The point I was making was that the OFT are fairly useless however when the FSA take over this should improve. It is interesting to note that the if you make a complaint to it about the conduct of a regulated firm, the firm has to pay the costs of the process.
Also, the decisions of the FOS do not need to follow the strict legal process (i.e. he can take into account fairness) and his decission is unappealable by the firm, but not by the consumer.0 -
