Bought ebay item £110,not received and seller has gone AWOL!!! Now what do I do???

To cut a long story short, bought an item througha private seller on ebay on the 6th June, a tent extention. Did not receive the item over a week later, emailed the seller, he said he'd take it up with the Post Office, waited, waited, to be fair he emailed me back and kept in touch. He said Post office said that a query could only be raised after two weeks. Ok, so I give him anther week. Item still not arrived. Apparently he paid just under £20 for the postage but surely he would have a tracking number to track the item on line???? Anyway week last monday told him that we're going on holiday in 3 weeks (true) and need the item asap and if I can't get it from him then I may have to go somewhere else. Anyway, last monday my husband is getting impatient so (as with all my emails to him) ask him politely for a refund as I can't wait any longer (on monday it will have been one calendar month I will have waited). He emailed back that it was me that had to organise this through ebay! Thought that was strange, so called ebay , found the right bit about refunds on ebay (pretty quickly I may add), so I emailed him the information about how to process the refund. Ebay did tell me that thay can raise 'a case' after 45 days against him. I don't think its been quite 45 days yet. Not heard a thing from him. I emailed him again 3 days ago, being pretty direct saying that I need to get a email from him and to process my refund before the weekend. I have heard nothing. What do I do? Is this guy a p*&% taker or what? He has 100% as a seller but as I have not ordered anything through ebay like this before not really too sure what to do?
Please help? Cannot afford to lose £110!! What shoud I do next? Have not left feedback yet as (being trusting) wanted to give him the benefit of the doubt, but I do feel like throwing the book at him.:mad:

Did you pay by paypal? Open up an INRC claim. Do this now, you only have 45 days.0

That was quick, thanks!
Yes I did pay through paypal but the lady at ebay said that I could not raise 'a case' whatever that is, until 45 days???????

You need to open a dispute NOW or you will lose your money you have 45 days to claim from making the purchase. Open a ITEM NOT RECEIVED dispute now. I would personally open it with payPAL. Good luck0

You can open a INR 7 days after winning a item.0

INR=item not received dispute0

log into your my ebay, use the drop down box next to the item to report a problem and open a dispute tick all the boxes to whats happened.
Or log into paypal find the transaction number and lodge a dispute that way.
Either way will see a dispute sorted.
I used the ebay dispute a few weeks ago and it was sorted within a few days.0 -
Not all ebay operators have a good command of English could this have been the case. Its sounds like they have misunderstood or something. Waiting 45 days is a huge no no.0

Thanks all.
I have just raised an online case as the ebay offices are closed now.
Do you think this will suffice or should I really raise this with paypal aswell?
I can't believe I believed this guy??!!! What an Ar$& Ho!& !
The ebay woman definately said 'cannot raise a case util after 45 days'!! Bl**dy good job I started this thread!
I'll let you know what happens.
