    Got a letter today stating that my HBOS credit card interest rate is being increased from 22.9% to 25.5%.

    Their rates may suck but their timing is impeccable - I just made a faster payment to clear the whole balance this morning, just under £500.

    Not sure if this is the right place to post, but you are all helpful in this topic, so thought I'd post. ...

    My OH has a default & CCJ registered from a company called CL Finance.

    He also had a default listed from Aktiv Kapital.

    It turns out that the CCJ and both defaults all relate to the same debt and CL Finance passed on the debt to Aktiv.

    The debt has been paid in full to Aktiv Kapital, their default is now marked Settled.

    Equifax have been NO HELP what so ever.

    I made him contact CL to get them to mark the default to settled and they said that they can see that it's paid but need official notification from Aktiv.

    So, my question is, can two debt collection agencies list separate defaults for the same debt??

    If not, does anyone have any advice on what to do?

    As far as I know, they cannot default the same debt twice. However because the defaults are from two different companies, I'm not sure where you stand with this. Equifax may view this as being two seperate debts and that's probably the reason why they aren't much help.

    Have you written a letter to Aktiv explaining all of this?

    Hi Elky,

    It's the same debt that CL Finance sold to Aktiv capital.

    Overall, it's an old GE Capital account.

    So, the same account with two different collection agencies.

    He Spoke to Aktiv Kapital last night, they said they are going to inform CL.

    I just didn't think they could report two defaults for the same debt.

    I had a simular issue about 4 years ago. It took about 3 months to sort out if i am honest.

    I had to get the company that had marked the default as satisfied to write to me to state it was paid off in full , the amount and who for along with the dates i defaulted and the settlement date.

    Then i had to forward a copy of this letter to company 2 along with a copy of my credit file that showed the 2 defaults for the same debt..co 2 finally liased with company 1 to get it removed. Make sure you label everything COMPLAINT as they have x time to resolve compliants.

    I did also contact the ICO bit they take months, infact it was 13 months before they even got in touch with me! (by which point i had it sorted)
    TBH it could have been sorted quicker i exepct but i took my foot off the gas a little.

    If they are saying all they need is the info from the 1st company then maybe a quick call to speak witha manager may (fingers really tightly crossed) get things moving..all they would need to do would be fax something over to confirm payment and ask for the 2nd default to be removed

    Trouble is with equifax now is they have moved the customer services to mumbai, which mean any question you ask them which is not down on there little sheet of paper, will not get answered properly.

    I think there is actually a law where you can't be defaulted for the same debt twice.

    Yeah it's quite common for debt collection agencies to sell debt onto other agencies. Though usually when the initial default is put onto your credit file, it can't be defaulted again regardless of how many DCA's the debt passes through (or so I believe).

    Equifax can't remove defaults without the permission of the company who put it there but usually they would query the company on your behalf regarding the dispute.

    It's likely that this is just an error, perhaps they weren't aware of the original default or assumed it was for another debt.

  • I think you may find Aktiv will be very helpful in this matter at the moment. From what Im told company is in the process of sale and they dont want any nasty reports to the ICO or similar to mar the sale........ I know a few people who have had success getting stuff removed from them at the moment. And by email too.:T
    3 defaults removed,, 1 judgment set aside
    No debt - 1 mainstream card
