    You could alternatively ring ICE and explain your situation, I have done this in the past, and they have been very helpful, they listen to what you are saying, tell you honestly what you can expect of them, and clarify your situation/expected outcome.

    Just stay strong, you will have to go through this story time and time again for a while to come yet! In truth YOU are the best person to write such a letter, as only you, know the ins and outs and personal details of your case, by all means put a letter together and we are all here to help with comments etc

    We were explaining our scenario for over 2 years, until we managed to achieve some success at Tribunal, but sure the CSA have more hurdles for us yet , never trust them, or think it's all over!! Cover your back at all times, and keep all evidence. In our case they informed us of a decision they had made in Dec 07 in April 08, but the totally incorrect decision/assessment they made was then backdated to further assessment dates from Feb 06, Nov 04 & Jan 04, then they said we owed 34k in arrears, thus the LO, CCJ, charge on hous etc. We have successfully won our appeal for the Jan 04, Nov 04, and Feb06 assessments, we are still appealing assessments dated Dec 07 and a new one of Sept 09. But we know we do not owe this money, we have the proof, so, in the midst of this there will be cr** ahead, but the jist of it is, you SHOULD have been awarded a funded DNA test, and you SHOULD NOT have had an assessment made on assumed parentage, as CSA dictates so, they are in breach of their own laws, so you just need to get to an appeal situation, as we did, to prove your case. It will come, but can take time. Keep your chin up, and fight, do not let them bully you. At times I resented my husband for our situation, ut in truth it was not his doing, but the strain on our relationship has been unbelieveable, but we are hopefully coming through the other side now, as you will.

    :) Awww bdt1..and kelloggs..and all...you have been SO suportive AND god-damn helpful..;)
    Without you all I do NOT know what I would have done this past 2-3 weeks, as I was scaling walls trying to fight this alone..
    Sadly our MP just forwards everything I send him..he does not seem to fight the case TOO much..but I have told him everything you all said to say ( which is legally/lawfully correct by the CSA Rulings of 1991)...and I HAVE now informed him of the latest letters /Enforcement etc...and asked that he help us via the P.O..
    I am going to call ICE tomorrow ( Drs at some point during the day too...as the stress is playing havoc with our health probs atm...:(...)
    AND I will contact NACSA too ( any idea HOW much they charge...as pennies are VERY short...Dammit!)
    I've gone over & over this story with every single person from the CSA I have spoken to..so I guess a few more will not hurt...;)
    Do you think I should request ANOTHER visit from someone(WHO do I ask to come out??) from the CSA again..and stand my ground on this Enforcement (guess I cannot stop it tho??)
    I know the rulings are clear..but I REALLY want to know what Section 33 is..in the rulings,that gives them the Right to take the case to Enforcement...
    How do I find THIS out ( God I am SO useless on a computer..SUCH a technophobe...I've no idea where to go OR look!!...DER!!)

    I guess what you & kelloggs say hits the nail RIGHT on the head..broken down it boils down to the Right of Parentage not being in place in 1993-97..his lack of funded DNA test being offered and they should NOT have made an assessment on 'assumed parentage''.......
    EVERYONE keeps saying to me..'But its not YOUR case..why ARE you going through all this' ....so I know what you mean by feeling resentful..However..I am not so much resentful at my OH...but I AM with the CSA as he has a RIGHT to know..but has no idea where they went as of ( a few months after) when they split up...
    I've gone back and forth between the CSA,the Local MP and the Courts for SO many years now..TRYING to find a way to get the DNA test..but having NO money..and all along I never realised THOSE rulings that were in place..so THANK YOU from the bottom of my heart for ALL your help..:)
    Will keep you posted once I have spoken to ICE...:)

    :) Hi All......
    Have just contacted ICE via telephone...but sadly they inform me that as I have not gone via the Chief Executive as yet, that they cannot deal with the complaint/case.
    I informed them that I have written to the Complaints Dept, Arrears Dept and the Client Service Director amd Local MP and they said that whilst this was all correct, until I have been advised via any correspondance and/ or contacted the CE that they cannot help...:(
    Apparently the Client Service Director 'SHOULD' respond to my complaint ( nothing as yet...but I guess it is early days...:s)..and once she has, my next step up ( as of now) is to write to the CE...

    So...today I am composing my letter to him..
    In the meantime..feeling VERY sick..unable to sleep etc etc...as am petrified of this Enforcement which presumably will STILL be heading forward , even though I have bombarded everyone with my reasons for wrongful handling of the case,complaints and issues against the CSA.
    Dammit!!!! :(

    :( Just checked my emails and found this from our Local MP....

    Dear Mrs *******,

    I have dictated a letter to you, which is on its way, enclosing a copy of the response that I have received from the CSA and which, from their point of view, is definitive and final. In it they indicate the course of action that they have clearly indicated, also, to you and have advised that you must take court action if you wish to press the paternity issue further.

    That, I fear, is not a matter that I can resolve.

    I would suggest, therefore, given the alternative advice that you have been offered, that you now refer the matter, as has been suggested to you, to the Independent Adjudicator and then, if necessary, to the Ombudsman.

    If you prepare a submission to the Adjudicator I will, of course, be pleased to forward iit with a covering letter on your behalf.

    I have been only ever advised by the CSA to contact the Client Service Director OR take the matter through the Courts...
    Any idea WHY the CSA have never given me any other addresses to complain to up until recently?

    I just wondered, simply as it seems to me that they have dragged this out for as long as they are able, without informing me of the relevent complaints depts or people to write to...and without all your suggestions I would still be going round in circles...:(
    MP does not seem to be MUCH help either......Sadly..:(

  • NACSA charge you £50 to join and for that you'll get unlimited email and telephone support. They know the CSA inside out, and all of the legalities within CSA law.

    If you feel that this is getting too much for you, you can completely hand your case over to NACSA but they'll need a one off fee of £150 and a further £15 per month. Bargain compared to what a solicitor would cost. They will liaise with the CSA on your behalf, totally. They'll send you copies of everything.

    I would like to suggest that you find a way to drum up this money and let NACSA take over. You sound really stressed, and I don't think that is good for you. Could your daughter help you out, I'm sure there is someone close to you that would be happy to help if you asked.

    I don't mean to sound glib about money and I've read your posts and know you are stretched as it is, but I think this is something you should consider for the sake of your health?

    I keep reading your posts, I don't always comment but leave that to those who know the answers to your questions.

    I hope my bit about NACSA helped.

    Stay strong, but don't let this make you ill. This could, as Bdt1 says, take quite some time to sort out, and you need to reserve some energy.
