Thanx Kelloggs & BDT1..
OK SO latest update...I emailed the Manager at the Data Protection Unit complaining that it had (then) been 42 days since I applied for the DPF...and here is the reply I received last night...
Thank you for your e-mail regarding the request for your personal information.
Using the details you have supplied, this morning I checked our records in the Data Protection Unit to determine the status of your request. Unfortunately I could not find any trace of your request. I investigated further on our main computer systems and found a letter dated 29th June 2010 from ******** ***** (me) indicating a Subject Access Request had been made. I am taking this letter as a request for your personal information under the terms of the Data Protection Act 1998. I can only apologise that your original letter of the 28th June 2010 has not been passed to the Data Protection Unit to process.
Last year, the Agency introduce a £10 charge to process Subject Access Request. In this instance, this charge has been wavered.
To expedite matters, I will treat your request as a matter of urgency and initiate the process today. I have your address from the letter and I would be grateful if you would confirm this as the address you wish the information to be sent.
Once the information is gather from the different areas that are dealing with your case, it will be despatched to you by recorded delivery.
So..needless to say..I promptly (this morning) got straight on the case and replied with another email...attaching proof of the letter (written on 28.06 and) sent on 29.06 via RECORDED DELIVERY ( attached proof of this) also attached proof of the postal order ( for £10...the charge for the DPF) and informed them that I will be including this 'complaint' in my letter to the Information Commissioners Office.
Somehow..I have this 'dodgy' feeling that they are withholding the DPF for as long as poss...and I truly believe it MAY well arrive, having been 'doctored'... Sneaky Bummers......:(0 -
If it does appear doctored - again complain and involve ICO0
-
Didi, thats appaling! The same happened to me, my 'request' was not passed to the correct desk for action. I hope you get it soon, and I hope it will unravel all your unanswered questions.0

Ok...so I wrote another email to the Data Protection Unit Manager today...the reply is as follows.....:)
Thank you for your e-mail and confirmation of the address.
As I mentioned in my previous e-mail, I will waver the £10 administrative charge. I will organise for the £10 charge to be refunded to you. This can be paid directly into your Bank Account or by payable order/cheque. If you wish payment into you Bank Account, you will need to furnish me with:
the name of your Bank or Building Society
the Account name
the Sort Code
the Account number.
Alternatively, instruct me to pay by payable order/cheque.
I have encountered a problem with printing your attached letter of the 28/6/2010. I recognise it as a Microsoft Word document and I have the appropriate version of Microsoft Word to read it. However, it appears to be 'blank'. Can you please resend the document and use Rich Text Format (RTF) as this will allow me to use a variety of software to read it.
yours sincerely
So....any ideas as to WHY??????..This one has me TRULY stumped..The CSA offering to give us money back???
WOAHHHHH!!!!..What IS going on???....................(PS...Spelling and grammar are somewhat lacking...:s.)

Be very wary of giving them your bank details - I wouldn't trust them, they have powers to remove monies(from your partner's account anyway)without your/his consent.
I would ask for a cheque in the post, or payment to be made in an account which you hold in your sole name only, and under no circumstances give details of your partner's accounts - they can find these out anyway, and may do so at a later date!!0 -
Had already thought of that one...So I asked for a postal order..which is already agreed to be sent..;)
OH account has SO little in it anyway ( remember he is registered disabled also) and they cannot touch his disability monies by Law..and anything else is in my name only...
Thanx for that BDT1 anyway...I never give out any account details on the internet or on the phone...;)0 -
Hi All....Today IS the day that the Court hearing has arrived....
So..having received the letter early August saying the Complaints Dept would contact the Legal Enforcement Team to inform 'them' that until an address where the MEF was sent was ascertained, they needed to hold back the Court date. However, they have promptly gone ahead and STILL issued the hearing date (for Sept 1st @ 9.30 am when we are ALSO away)...
Kelloggs...Anyone...any ideas what to do next???
I REALLY do not wish to talk on the phone to the CSA anymore, and HAVE informed them of that..
ALSO..as I am disabled and have to attend the Court on behalf of my OH..I just do NOT 'DO' mornings due to my medication having to work before I can get 'up & going'....
WHAT CAN I do???...:(0 -
Meant to say..the Court is almost an hours drive away from our home ,also....:(0
