    I agree with Kelloggs - in our case they got LO, then it took a good 6 months before interim charge was obtained - bet it takes a lot longer (in our case) to have it removed tho LOL bet they not so quick to remove it now we proven it was never owed in 1st place!!!!!

    Sorry...but I have no-one else in this situation to ask..and no support from OH family so feel totally alone in this, apart from all your advice ( which is great)...
    I called NACSA today as advised..and I am getting the charge set in place ( or validated IF there has been a mistake, as the Solicitor seems to think MAY have happened due to the wording on my DoT..(still do not understand it though...but I will ask the solicitor anyhow....
    In the meantime...does anyone know IF my £40,000 will ALL be protected ( plus interest) with the charge in place???)....
    Plus as NACSA advised... I am to also go see about a statutory declaration regarding all the contents of our home being mine also...( more cost..dammit!!)
    Trying NOT to race ahead in my thoughts...but sadly the CSA is a tiny piece of a MUCH bigger mess up in our lives..so I try to be ahead of myself in preparation for any event...:(

    Have you got the data protection print yet? They have to get an LO first before they can do anything else.

    Nope....it has still not arrived...:(
    I am wondering if the CEO has held things up a tad as I sent ALL the letters I have recently sent to all the various depts enclosed with the letter to him...
    Just keep wondering what is going to come first..and the days on what will arrive.
    I dread the mailbox every day..(rotten right now as it is all our birthdays in the next 1-3 weeks..so we SHOULD be celebrating)..and the wait is a nightmare....quite simply the not knowing..
    As you ALL already know...
    Makes you feel physically sick...does it not???...:(

    Don't hold your breath for the DP File to come within the 40 day limit (target CSA told us - ha ha, I did inform them no this is an actual legal requirement!), CSA are frequently over the 40 day time limit due to high demand (obviously) for DP Files at present!!

    I would mark on your calendar the 40th day, if it comes and goes, think I've already PM'd you the DP Unit Managers e-mail , phone details

    :) We are approx 1 week away from the 40 day mark...
    No DPF as yet...and no bdt1...you didn't PM me the DP Unit Managers email addy..so IF you could I would VERY much appreciate it..:)
    Am getting ready to call NACSA when it arrives as I am sure I WILL need help deciphering the coding..AND I anticipate it being doctored as I previously said...:(
    How devious CAN they REALLY be????

    :) Day 42 ( do the weekends count with this application???) after applying for the DPF....
    The DPF has still NOT arrived...:(
    However...I did receive a letter last week saying that they are looking into the address of where the MEF was initially sent to...and IF it is found that the MEF was issued to an address where my OH was NOT living ,then ''all action will stop''...(bet it won't..I bet they will try and re-start another case and backdate it...somehow)
    Have been to the C.A.B (they ARE useless with CSA matters..this site is FAR superior in its knowledge)...and have also now been to the Solicitor...
    I now have a Statutory Declaration for all the contents within the boundaries of the property,sworn on oath and signed/stamped by my OH and the Solicitor..
    Also have a Legal Charge going on the property ( for the amount I placed down as a deposit on the house, plus 5% interest), as stated in 2001 on my Declaration of Trust ( for some reason the Land Registry did NOT put it in place at THAT time..so the Solicitor is kicking butt about that....

    In the letter which arrived it states ''I have contacted the Legal Enforcement team to advise them of the actions that are currently being undertaken on this case, however, the decision as to whether or not to continue with their action whilst these issues are being resolved lies solely with them. You can contact the Legal Team dealing with your case on 0845 6090052''

    Should I now write a (signed for..of course) letter to the Legal Team ( at which address??)..and what to do about the DPF???
    Ideas anyone?????

    Write demanding the DPF and remind them that they are late - and therefore in breach of the legislation. 40 days is ample time. I would wait now until you have the relevant information before taking any more steps.

    Do I write to the CSA Data Protection Unit in Newcastle regarding the matter???As that is where I applied to for the DPF...

    Ok write to Data Protection Unit in Newcastle, also copy your caseworker/Legal Enforcement so they are aware of what is happening. Worth a letter to legal enforcement although inour case they didn't stop enforcement, wasn't until ICE involved that they agreed not to take further action (by then they already had charge, LO, CCJ), but at least that was up to a specific date, they couldn't chase for anything after that date!), but suppose it's worth another letter - maybe you hit lucky??
