Neighbours damaging fencing and trespassing.

  • we looked up hours that are considered reasonable online (that is, reasonable in the eyes of councils, police etc) and found 8-8 all week. However we try to keep to 10-7.


    7 days a week?

    I wouldn't find that reasonable if you lived next door to me.

    Working Hours
    The Authority would not normally place any restrictions on sites, with regard to working hours. However
    within the City noisy activities would not be expected to be taking place outside of the following hours:

    • 07:30 to 18.00 hours Monday to Friday;
    • 08:00 to 13.00 hours Saturdays.

    In order to ensure respite to the local residents, where noisy works do arise, the Authority would expect
    there to be no work undertaken on Sundays or Bank Holidays.
    Noisy activities are defined as those where a neighbour, whether residential or commercial, could hear
    noise activity in their house or garden, or at their business premises. There is scope for negotiation on
    these hours especially if there are no immediate neighbours, or there is particular noise sensitive
    properties involved or specialist work has to be undertaken.

    We don't work on the house all those hours, 7 days a week, or we wouldn't need a camera to supervise our garden ;) it's perhaps 3 evenings a week at most, and then one or both weekend days, but again, not every weekend, and not always both days. We have tried asking when they'd prefer we work, they simply say they'd prefer we didn't. So we try to stick to the hours I stated before. The noise isn't constant, as there is just the 2 of us doing the work here, it's all just the normal ammount of noise you'd expect from doing up a house from scratch. We even plan it out so that any work done on adjoining walls is done during times when their child isn't likely to be asleep, and certainly not early in the morning.

    This isn't helping with the fence problem, fun though it is ;)

    I would have thought it's worth contacting the housing authority and saying their tenants are causing damage to your fence and so they should pay for repairs.

    From the incident you describe it doesn't sound as though they are deliberately trespassing and trying to cause trouble - just wanting to get their ball back the quickest and easiest way - can you increase the fence height with trellis or something to stop the balls coming over in the first place?

    From what you've said I foresee you not getting anywhere with your complaints - subtlety will be lost on them and offence will be taken on anything unsubtle. I'd protect the bunnies, get the work finished on the house, plant some hawthorn along the fence and put the place on the market immediately the work is done. Hopefully you'll be quids in and won't have to admit a dispute on your sale documentation! Good luck.

    Also, I suggest you go & have a read of what you did write.

    And I think you will find the rules pretty much exactly the same across the country.

    Whether they imply just to a company of builders or people like yourselves I wouldnt know.

    As for the fence, you have had my opinion already but be prepared for a hit back on the noise issues as you have already stated it is a problem to them.....

    There aren't fixed rules for DIYers. You can't seriously believe any one would make rules that say people aren't allowed to do DIY for 3/4 of the weekend!
