    Strictly speaking you are right, however, not accepting the FPN would mean prosecution is almost certain to follow with all that entails re: costs, time, court, greater fines etc.

    To the average guy in the street, certainly for us then, having to go to court was out of the question. As far as I'm concerned a FPN is a prosecution in all but name.

    I would be surprised if a person went to court to argue their case about breaking the speed limit, against a manned camera. If the correct discretion has been used by the operating officer, what defence could possibly be used? At the end of the day you are breaking the speed limit.

    Fixed cameras has the lines and tell you the time that both pictures were taken thus very hard to dispute.

    Opersting officer with speed gun is not accurate as shown in previous posts.
    I all have learnt is from others on many sites.
    Seek legal help if unsure.

    I agree. As has been posted previously, prosecution is ""To follow through; to commence and continue an action or judicial proceeding to its ultimate conclusion."

    Backs up what argument?

    I believed I had already demonstrated that the guidelines you posted specifically state that anything above the speed limit is down to the officers discretion (manned).

    People on this thread have stated that they have known people to receive FPNs for doing 3mph over the speed limit.

    What more do you need?

    It will be extremely difficult to find somebody who has scanned up their FPN with all their personal details on etc. to let the world know that they were caught speeding.

    You posted up the guidelines!

    The link you provided to WYP states they use the thresholds provided by ACPO.

    ACPO Thresholds are guidelines!

    The thresholds as provided by ACPO clearly state, straight after the thresholds, as clear as can be, that they do not and cannot replace an officers discretion. End of story.
