    As soon as someone produces evidence that a prosecution for a 1,2 or 3mph contravention has taken place for speed alone, then you will have proved your point. Shouldn't be too difficult. Until then, I say it's you talking utter bollox!

    My wife was prosecuted for 33 in 30 some years ago (5-6 ish). I lived with her at the time (still do) & saw the NIP, with my own eyes, the speed was clearly printed. Mobile detection van, past a school, 10.50 am.

    I wrote to the scamera partnership & then to the Chief Constable & got very similar replies... in essence, accept it or plead not guilty & go to court!

    I then enlisted a solicitor friend to have a look, his advice? .... with the costs involved/difficulty trying to fight it I'd pay the fine & have the 3 points!

    This isn't some game of chinese whispers passed around in the pub, it happened! You can believe it or not, makes no difference 'cos you're wrong!!!

    Maybe not prosecuted, but they could have received and accepted a fixed penalty, being 3 points and a fine.

    Done = Found guilty

    Prosecuted = might be guilty or not.
    I all have learnt is from others on many sites.
    Seek legal help if unsure.

    Did you not read the ACPO guidelines that you provided the link for?

    It clearly states:

    "This guidance does not and cannot replace the police officer's discretion and they may decide to issue a summons or a fixed penalty notice in respect of offences committed at speeds lower than those set out in the table. Moreover, in particular circumstances, driving at speeds lower than the legal limit may result in prosecution for other offences, for example dangerous driving or driving without due care and attention when the speed is inappropriate and inherently unsafe."

    So it is totally reasonable that people have received fixed penalty notices and points for doing the 1, 2, 3mph above the speed limit.

    However, as you were talking about prosecution when you were referring to your article in Lancashire, that is a different thing altogether.

    Prosecution being:

    "To follow through; to commence and continue an action or judicial proceeding to its ultimate conclusion. To proceed against a defendant by charging that person with a crime and bringing him or her to trial."

    Therefore, is it not you that is the muppet?

    & what? That's Lancashire, I don't live there!

    My point is that when you come onto an internet forum & call people liars you should really have all the facts!

    The fact is.. you can be prosecuted for exceeding the speed limit by 32, 33, 34 mph & people have been.

    The fact is... the ACPO guidelines are exactly that, guidelines! Nothing in legislation to say any force has to adhere to them, nor is there any defence by trying to prove they didn't!

    To further answer kings point... whether you choose to defend or not is your choice & will depend on a number of factors, mostly how much cash you have to throw at it!. To defend you must be prosecuted, yes?

    OK, re "abuse", I withdraw the muppet. But, if you had read the article, you would have seen......

    "New thresholds for people caught speeding mean that in a 30mph zone, prosecution is now only automatic at 38mph, when previously it was at 36mph. You see, there was never zero tolerance.
    Instead, under the previous policy, motorists caught speeding at 35mph in a 30mph zone were offered the opportunity to attend a speed awareness course as an alternative to a fine and penalty points -- something which will now be made available to those caught driving at 36mph and 37mph."

    Seems pretty clear to me.
