My question is, after reading all of the (hundreds) of posts, obviously these people are trying the same thing on with me, but do I wait to see if the blithering idiots actually put something in writing to me first... or just go in hard with a letter from the templates on here???
Many Thanks, A rather bemused, B.
Just wait, beanie - if they really have something important to 'discuss' with you then they will, eventually, write to you.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

So basically write to them then? I am just concerned that they are going to try and start CCJ proceedings straight away. Can they do that if I offer to make a repayment plan?0

Hi Rog
I hope you have had a good start to the new year so far.
Well I have received a response to my request for my credit agreement letter.
MH have returned the £1, stating that my account is on hold and no further action will be taken. they have requested information / proof from their clients and if they have not heard from them in 40 days then they will refer matter back to client.
I am sure they only have the 14 days (which has now passed) as outlined in the appropriate guidance or am i wrong in this?
Thanks for any advice given.0 -
I am having trouble with these people. I know that I have a debt outstanding with Black Horse Agencies - I have emailed 5 times to Mackenzie Hall, to which they havent reponded, I have faxed them to which they havent responded. I have now written a letter to DFS/Black Horse telling them about this debt collection agency. They keep phoning me on my mobile and now they have phnoed me at work. He started to talk so I said "can I just interrupt you, I am not willing to talk to you on the phone about the matter as I have emailed you various times without a response" he kept cutting me up so I said in the end I am not talking about it on the phone and if you persist I shall put the phone down, he said "well I shall just keep ringing you" I said, you do that and I will call the police for harrasement" he said by all means do that. I put the phone down and yes he keeps ringing. I am livid. I am going to write to DFS/Black Horse and see if they will accept a direct debit from me directly to pay this. How can these people be so vile???0

The plot thickens for me, I have written to them and sent a copy of the letter and my income/expediture statement via email to try to negotiate a payment plan. They have emailed back and are refusing to negotiate (after going through security details over email). They have told me I must pay within 7 days or face a CCJ (even though last week they enforced a payment plan which I could not afford). What can I do now? I have received advice from the national debtline and followed that and yet they are still refusing the negotiate as it was a "30 day credit agreement that should have been paid back immediately".
As this is still part of the consumer credit act 1974 (it was a payday loan which I know was stupid to take out) is there anything I can do at all?
Cheers

Go back to my last post on this thread (page 17) and follow the instructions there.0 -
What an interesting thread this has been (yes, I've read every single post in it - how sad am I!
Anyway, I had TWO letters from this mob this morning! Immeidately googled their name & found this thread - most enlightning!
I did have a default on a CC which the CCJ expired (6 years-wise) some time in 2001. However, I've received TWO letters from them, each with a different ref number so I'm not sure what the other could be.
The only other thing I can think of (i've been "spotless" financially for at least 12 years now) is perhaps some (very) old parking tickets, again, minimum 12 years ago, before I moved out of london.
In the case of such tickets (if it is them, but I won't bother contactint MH to find out) as there'd be no credit agreement etc. how could you request "proof" of such a debt?
Once again, a very interesting & useful thread!

Having read these posts I am now scared.
My old boss has emailed me saying Mackenzie Hall had sent a letter to his address for me. I have absolutely no idea what this is about, I no longer work for said boss as about a year ago his company folded and I was made redundant. Previous to that I'd only worked for him about 18months or so.
After reading some of these posts, a lot of it seems to be about debts which are nearing 6 years old. Well I haven't even know my ex-boss that long!
If they're trying to trace me over an old debt (that I know nothing of) surely they would at least write to my Mothers address (as old post still sometimes goes there even though I've not lived there over 3 years now).
This is worrying, obviously ex-boss said he didn't have me details (not that he woud pass them on anyway) however the leter did say I was to email to given address or ring quoting a reference number. Well I am certainly NOT GOING TO RING, I don't particularily want to email or enter into anything with them. I am confused as to why they've picked me and at my ex-boss's address???
Any ideas what's best to do?0 -
MH phoned my daughter who lives in a different part of the country asking where I lived. She declined to say. I phoned them using the reference number she had and asked them what was going on.
They addressed me using my previous name ( I re-married 8 years ago). They admitted they didn't have my daughters address (yesterday) but they phoned her today saying I had an outstanding debt and also I had been trying to get credit using her address. Obviously not true, I live in different part of country. Left bad feeling between both of us.
I phoned them again. They said they hadn't phoned daughter as they now had my mobile number.Obviously untrue. I have contacted OFT with official complaint as I have read they are trying to get a case against them.I have also tried to phone Trading Standards in Kilmarnock. The person I need to speak to won't be in work until Monday.
Should I write to MH? Are these people able to just act as they like?0 -
:T Hi Beanie, I was woken by the automated text this morning on my landline and did the same as you by looking them up and getting this thread, I have been getting letters from Capquest (another of these so called debt collectors) say ing I owe them £10,000 from 11 years ago and I sent them an email of a letter the police gave me, after telling them I had no knowledge of the debt and sending them a photocopy of my passport I received a letter saying that the account was on hold, that was the 18th Feb, i can only presume because the could not prove the debt they have sold it to mackenzie hall, in the letter I told them to look up and read the limitation Act and also the Administration of Justice Act 1970 section 40 on harassement. Try this if mackenzie hall carry on they will be sent the same letter, they cannot harass you like this and don't let them back you into a corner and admit the debt you don't owe.Hi all!
I had an automated text sent to my landline number (which I don't give out to ANYONE!) yesterday afternoon asking me to contact 'amy' urgently on 01563 ...... quoting reference number ......'
A quick search of their number threw up all kinds of things, notably, this thread! As far as I am aware, I have no debts apart from a £45.00 catalogue which I only put on the account last week and intend to pay at the end of the month when the statement comes in!!!
My question is, after reading all of the (hundreds) of posts, obviously these people are trying the same thing on with me, but do I wait to see if the blithering idiots actually put something in writing to me first... or just go in hard with a letter from the templates on here???
Many Thanks, A rather bemused, B.0
