Hello all!
Long time reader/fan but I felt the need to register and reply about my MH experiences. What a bunch of bullies! Anyway, I have also emailed them and I thought I would share it. I will let you know how I get on.
Next plan; OFT. It wouldn't be so bad if I actually owed them money, but for once in my life the debt collectors are wrong! I am therefore enjoying the moment.
Good luck to everyone going through it with these bullies.
Ref no: *******
Dear Sir/Madam
This email is in reference to your call on the 4th/11/09
I did not receive your message until late this evening so please accept my apologies for not contacting you via telephone.
I know what this call is in reference to as I have spoken to a very ill mannered telephone representative from your company a couple of months ago. For the record; I DO NOT respond to bully boy tactics!
I DO NOT owe any money to AOL and as you can see I am infact emailing you from a talktalk/AOL web address, which of course would be impossible to do if I owed them any money.
I did try to explain this to one of your representatives and I was told that I must prove I do not owe AOL any money, as you can imagine this is quite difficult to do when I no longer have an account with them and have not done so for about 3 years!
To try to sort this out I then contacted AOL who assurred me that they would get in contact with yourselves and tell you that I did not owe them any money, they also were concerned as to how you got my details and why you are chasing me for money which I do not owe. I would also like to know this as well please?
I was a long standing customer of AOL's, I never missed a payment and I only switched to Talk Talk as they could offer me a better deal including telephone charges. AOL were of course aware of this and didn't really care, as of course they are actually a subsidary of Carphone warehouse, who of course own Talk Talk...all the same family.
I suggest that you check your information and then remove my name and details from your records. I do not expect to hear anything from your company again, apart from an email of apology, assurring me that you have removed my details from your records and to explain why you have my details. I expect this email to be sent within the next 48 hours.
I will be checking my credit reference file and I can assure you that if anything untoward is on it then I will be consulting my solicitor. I am in the process of applying for a mortgage and if your company has done anything at all to harm my application then I will NOT take this lying down.
I look forward to hearing from you within 48 hours with an apology, an explanation and your assurance that you will not be contacting me again regarding this matter.
Yours sincerely

You are better off, when dealing with the ilk of MacKenzie Hall, simply to send off the 'standard' Statute Barred or 'Prove It' template letters that you will find on http://www.nationaldebtline.co.uk/england_wales/debt_advice.php#6 or http://www.nationaldebtline.co.uk/scotland/debt_advice.php#6 depending on what the 'debt' is for and where you live.
The chances that the 'automaton' on the end of a phone line will be acquainted with the details of the alleged debt are, quite frankly, less than zero - as are the chances that he/she will have any knowledge of, or respect for, the 'Guidelines on Debt Collection' that the Office of Fair Trading has established, and to which the sub culture of debt collection that is represented by the thugs at MacKenzie Hall should, but rarely do, adhere in order to retain their 'licence'.

It is always worth reminding MacKenzie Hall that they are already the subject of an OFT 'requirement' for their handling of disputed and unenforceable debt:
http://www.oft.gov.uk/shared_oft/business_leaflets/consumer_credit/requirements.pdf
Personally, I would recommend that anyone who has the misfortune to have to deal with this bunch of semi-legalised recidivists, prints off a copy of those OFT requirements and staples it to any letter that they send to MH.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Hi - I have signed up here as I to have been suddenly getting post from mackenzie Hall. What is the worry here?
I had a contract phone from Singlepoint and when I lost my job I could not pay so it went to court, debt collection. I paid when I found new employment to Red Debt and eventually had to get a letter from them confirming that I had paid in full as another debt collector got on the bandwagon and demanded the money all over again. Eventually they went away and left me alone but not before they had been aggresive and rude. This was 4 or 5 years ago. Now Mackenzie Hall are asking for the money all over again!!
If I have a worry it is simply what happens when you clear up the problem? How can these people pick this up and believe the money is still owed? This means that when you clear a debt then nobody makes sure that you are crossed of a list somewhere. Mackenzie Hall are ambulance chasing then?
A final question - what kind of "people" work for these companies? Do they live under stones or in the bottom of ponds?
I will ask Mackenzie Hall for the original documents/contract and see what they can manage to come up with.
Thanks for reading this.

Either category would give any potential candidate an edge when applying to 'work'for Mackenzie Hall.
In your case, I would get straight on to Trading Standards/OFT.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.

Hi, PLease help,
After reading this forum a couple of weeks ago I chose to ignore the first letter from this company. Today I received another letter which is a failure to respond notice..
I have checked my Experian credit file and there is no default debt for the company they are saying I took the credit out with. Also I have not had any correspondance with the Pursuer of the alleged debt which is 1st Credit Ltd. Where do I stand if this alleged debt is not on my credit file with Experian. I can see that 1st Credit did a search of my credit file on 29/01.09 for information but that is all.
What should I do, as I do not want baliffs at my door....0 -
