DO NOT ADMIT TO HAVING THE LOAN UNTILL YOU HAVE DONE THIS OR THE 6 YRS START AGAIN .
Hi don - I'm pleased to see that you got a result out of these scavengers - even though it took 3 hours.
I'd just like to put your mind at ease over one point, just so you don't worry:
If, and when, a 'debt' becomes 'Statute Barred', by virtue of the 'debtor' having made no payments towards it, or no written acknowledgement, for a continuous period of six years (five in Scotland) then that 'debt' remains Statute Barred.
Acknowledgements of the 'debt', whether in writing or by phone, even any payments made towards it, will not alter the 'status' of the debt.
In spite of what people like MacKenzie Hall would like you to believe, once a debt becomes Statute Barred that debt remains Statute Barred - that is the Law.
It is sufficient for a 'debtor' to inform the creditor, or dca, that he/she will no longer be making any payments towards that debt because the debt is Statute Barred (NO further reason is necessary) and the creditor/dca must cease all 'collection activities'.
MacKenzie Hall know this - they just assume (or hope) that their intended victims do not.
As they are, currently, on a 'Final Compliance' warning, from the OFT, for their 'behaviour' in pursuing 'unenforceable debts' then you, or anyone else who is being pursued by this greed driven horde of wolves, should consider reporting their behaviour to the OFT.
The actual OFT 'requirements' for MacKenzie Hall can be viewed on the following link:
http://www.oft.gov.uk/shared_oft/business_leaflets/consumer_credit/requirements.pdf
I strongly recommend that, when informing MH that a 'debt' is Statute Barred, 'debtors' should print off a copy of these specific requirements and staple them to any letter that they send to MH.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Hello all
I have received a letter from MacKenzie Hall requesting payment saying they have made enquiries with the Land Registry and they have received formal confirmation that I am a home owner and that they are going to commence legal proceedings.
I have emailed them 3 times in the last 10 days and to date they have not responded to me. I do not want to call them just to get "bullied and being made to feel small". I am conscious that they will put a charge on my house. Does anyone have any suggestions for me please.
Thanks v much :-)0 -

You should always send letters to any Debt Collection Agency, especially MacKenzie Hall, by recorded or registered, signed for, delivery.
Have a look on the National Debt Line website - https://www.nationaldebtline.co.uk/
There are some excellent 'template letters' that you can use to make your 'offers'.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.

Marlin are another 'extremely dubious' bunch of cowboys. They were featured on a recent Channel 4 Dispatches programme, for employing just the same underhanded tactics that MH have become infamous for.
If you hear anything from MARLIN, I would be inclined to report them to the OFT as well, since DCAs should not 'exchange' details of disputed debt.
Anyway - legally, at least, MARLIN will not be able to to anything, but they can be a right pain.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
