Item I have sold gone astray. Do I have to refund?

Hi
Wonder if someone could give me some advice. Posted an item I sold but it never arrived according to the buyer. I obtained a certificate of posting from the PO. Do I have to refund the money back to the buyer?
Thanks

Yep, the responsibility is yours where RM lose parcels.

Personally i try and stall buyer until week 2, but then just refund in full (in paypal refund the actual payment, don't just send a new one). Then after 15 working days use your certificate of postage to reclaim your loss from the Royal mail.

They way you should look at it is treat them as you would weant to be treated. How happy would you be to pay for something and it not turn up ? I suspect not very...

If I had obtained a certificate of posting, I would send that to the customer and get them to chase it up with Royal Mail. You did everything in your power to make sure it left you safely, so who's to say the customer isn't trying to scam you?

Its not like I'm a business, I'm a private seller, and this is ebay so its 'buyer beware' IMO.

The buyer cannot claim using the seller's certificate of posting. The seller must do that as the sender of the parcel.

RM cannot trace mail with a certifcate of posting and it is the seller that would have to make the claim not the buyer.

I would contact RM and make a claim with them. I hope that the item was not too costly as they only cover about £30

Not good enough I'm afraid. The contract is between the seller and the Royal mail, the buyer only deals with the seller. Therefore as I said in my earlier post the seller refunds the buyer in full and then claims back losses from the RM using the COP.

YEp - royal mail are quite good about it if you harrass them - you are covered up to £32. It's happened a few times with me, and I have phoned them and faxed reciepts thorugh etc. They have refunded immediately. They have no way to trace the parcel, so they will only pay up after 15 days. If you contact them before they won't want to know.

I have the same situation. I posted 2 items to 2 different ppl, one positively feedbacked me (in other words got the item fine), the other emailed and asked where the £1 DVD was. They were posted on same day. I emailed to explain that it had been sent, and replied he would keep an eye out for it and tell me if it arrived. But ultimately what happens if it never arrives?

I suspect as the item cost £2.50 total incl P&P, that they are not scamming me, but I didn't go down the recorded deliv route as the buyer didn't pay for it, so no proof of posting.

Looks like my options are this:
1)wait to see if it miraculously arrives
2)pay him his £2.50 and assume he is telling the truth
    3) Apologise and do nothing, and accept neg feedback that will no doubt follow.

    Your opinions please:

For £2.50 refund immediately and claim after fifteen days from rm there is nothing to think about here.

It's not the buyer's responsibility to chase up RM...that lies with the seller.....

That's not negotiable...RM would only deal with the person who posted the parcel......
