Phones2Udirect did not pay my cashback. After loads of trouble I recently issued a small claim against them. Today I have just checked on the progress of my claim....and they are paying out. I have also put in fifty pounds costs for my inconvenience. If anyone needs any help to get these crooks to pay out, you can PM me and I will give you all the help you need. WE ARE NOT GOING TO LET THEM GET AWAY WITH IT.

  • I'm considering going this route with OSPS, they messed me around with the Month 8 cashback. I sent my Month 12 cashback on 17th July and i still haven't received my cheque despite it being sent recorded delivery. This was with my orange contract, my cashback for the 3 cashback was paid very quickly. I'm thinking of using moneyclaim.

    I have a same problem , send my 1st cashback request 2months back. Still waiting, no money no infromation, they are awfull company to deal with. Currenly I am also claiming cashback from e2save - no problem, always cheque received on time.

    I am waiting over two months now, eventually got an email response saying they hadn't received my claim so I faxed them copies of everything today including the signature photo from the royal mail recorded delivery tracking website and threatening small claims if no cheque within 7 days so I may need to take you up on this offer.

    I too have had a nightmare trying to claim cashback from Phones2udirect.com. I sent my sixth monthly O2 invoice to them and after a couple of weeks, tried to contact them by email and phone to check that the claim was OK. I didn't get any response at all. Eventually, they wrote out to me (it took them over a month) saying that I'd sent my invoice too early - instead of being the sixth monthly bill, it should have been the first one I'd received after having the contract for 180 days! But as it had taken them so long to reply to me, it was then too late to get in my claim with the correct invoice within the 14 days of the invoice being issued, as they stated in their letter. They could've emailed or phoned to let me know, but no, it took over a month for them to write out. I then sent my next invoice to them, but it arrived to them 3 days after the 14 day cut off period so they rejected it and ignored my comments in my letter. (Funny it only took them 2 weeks to reply to my second claim instead of delaying their response like the first time!)

    Since then, I've tried numerous times to contact them but haven't got anywhere. Other companies I've claimed cashback from have texted me when my claim's been received to let me know it's being dealt with, but all you get from Phones2udirect are engaged tones, bland standard emails and, if you're lucky, belated standard letters that totally ignore any other correspondence you've had with them.

    Can I do anything?? I noticed in their terms & conditions on their website now that cashback claims have to be in within 21 days of the phone company's invoice rather than the 14 days they stated in their letter to me.

    It also says that any claims are dependent on successful earlier claims, so I fully expect them to reject any claim I make after my 9th and 12th monthly bills.

    Any advice would be greatly appreciated! The whole issue has caused me a great deal of stress....:confused:
  • I managed to get my cashback of 105 pounds back. They didnt actually put in the cost of the summons which was thirty pounds. Im about to chase that up. They are an awful organisation and I think they need to be legally reprimanded for all the deceit and lies they have been using.

    Am I so glad to hear you managed to get your money back from Phones2UDirect. Well done! And I can also relate to the sheer frustration, agro and hassle we are all going through with the idiots at Phones2UDirect who are no doubt in breach of their contract for not honouring their customers the full cashback on time. I also echo all the stuff that others have posted about this company. If only I knew and read your horror stories before buying a phone from Phones2UDirect.

    My 1st claim was back in August when I reached 180 days of connection with O2 network on a 12months contract. So I sent them my ORIGINAL statement bill from O2 (not a photocopy) together with a letter claiming for my cashback all by 1st class RECORDED mail ofcourse. I did my sums carefully and instead of working out which invoice, I counted the number of days from being connected on the O2 network to the date which coincided with the statement that followed 180days of being connected. I tell ya these idiots at Phones2U Direct make it extremely easy (NOT!) for any consumer to claim cashback.

    2 months went by without getting the cheque or any replies from them. Then I got an email on 6th October (2months and a few days later!) "Sorry for the delay, your claim has been escalated and you will be contacted shortly."

    Since that date, I have not had any replies or responses to my emails (now it's 6th Nov!!) which I have been sending to their cashback claims department on a daily basis via their website + via email (so there's no escaping the Totalturtle!). Everytime I speak to their customer service (it's always the same chap David Byfield - whose advise is that give it a few more days and keeping writing emails to Cashback Claims department as he cannot talk to them to help me). How disgraceful is that coming from Customer Services!

    So I kept emailing the Cashback Claims folks saying that I have filed a formal complaint with my local Trading Standards Office which I have done.
    They will be passing my complaint together with other similiar complaints to the local Trading Standards Officers in the town where Phones2UDirect are based.

    I'm not going to let these guyz get away no matter what it takes. If Trading Standards cannot take any tangible action with results, then Small Claims Court sounds like the route to embark on.

    At this very moment, I am preparing a written letter to Phones2UDirect (to be sent RECORDED delivery 1st class) to inform them that I intend to go through the Small Claims Court (my trading standards have also advised me the same) if I do not get my cheque within the next 10days of the date stated in my letter.

    Please can you give me any advice and insights on what specifically to do next with Small Claims Court i.e. MUST have things to include and things not so important to mention in the Claims procedure. Can one make a Claim online for Small Claims Court? Do you have their website address please? Thank you :)

  • ....Oh by the way MrsMondragon - forgot to ask your advice on the following; after writing a letter to Phones2UDirect today saying that I have filed a formal complaint with the local Trading Standards Office (in my area and in their area where they trade) + asking for my cheque of £120 which was due in August! and if they don8t respond with a cheque to me within 10days of them getting my letter --- shall I proceed with the Small Claims Court or wait till when my next cashback rebate is due which is end of November. But they will I'm sure delay things and Xmas looming around the corner, the chances are unlikely that they will ever get back to me. So my thinking that I act quickly.

    You mentioned of the 30 admin fee for each Small Claims Court submission, so shall I proceed with the Small Claims ASAP to get my first cashback rebate rather than delay things longer.

    They might cease to exist comes Jan 2007! So my inkling to proceed and add the £30 ad fee into my claim plus all the headache and annoyance they've caused me. Your advice is very much appreciated. Thank you :)

  • To all those folks out there still waiting for your cheques and getting no replies from P2UD, keep fighting and whatever you do DO NOT give up! There is hope. I know from experience cos I've been trying for 2 gruelling months to get a cheque from them but got no joy after sending them countless number of emails requesting them for my first cash back (August06). Last week I finally reported them to Consumer Direct and Trading Standards.

    Monday 6th Nov - I wrote them a very firm but polite formal letter (typed-up not hand written!) of complaint (RECORDED delivery always strongly recommended)pointing out that they had breached terms and conditions of their contract. I also demanded that if they failed to send me a cheque within 14days of my letter, I would take them to court!:mad:

    Saturday 11th Nov - Hey you guessed it. A cheque arrived by 1st class post. :T My letter worked!!! and saved me extra hassle of taking them to Court. I would have gone all the way, trust me.

    Hopefully, they now know I'm serious. My second cashback is due end of November so when I send my O2 invoice, I will send a clear warning in my letter that if they breach their T&C's again where the second cheque doesn*t arrive within 28days, I will take them to Court.


    Now if you want to get all your monies back, here's my two pennies :A

    1- keep all records and print outs of your correspondance with P2UD
    2- send everything by RECORDED mail 1st class on time!
    3- don8t count the number of months to work out which invoice you should send, instead carefully count the number of days you've been connected to your network provider and send relevant month invoice (ORIGINAL not photocopy!)
    4 - make sure you stick to their Ts&C's otherwise you don*t have a leg to stand on
    5 - if you don8t get any joy after 28 days of sending your cashback claim, then send P2UD an email and give them 7days to reply
    6 - if no joy after 7days, then follow-up with a reminder email and give further 7days
    7- if no reply, report to Consumer Direct and Trading Standards but they can only investigate but can8t help you directly to get your money back! The more cases of complaint people send, the more power it gives TS to shut down P2UD
    8- This is not enough, so write them a letter like I did. A formal letter. Be firm yet polite but never apologetic. They should be the ones apologising you!
    9 - In your letter, demand that they send you a cheque within 14days! If they don8t tell them you will proceed legal action promptly and swiftly!
    10 - In my case, my letter really make them SH** in their pants.
    11 - When your contract ends, don8t even think about buying a phone from
    P2UD. Go with e2SAVE (they are part of CarPhoneWarehouse more reputable and I've never had problems with them. OneStopPhoneShop is also trustworth from my own experience. They always send cheques on time. They are also part of CarPhoneWareHouse I believe, so big retailer reputation at stake if they get taken to court.)

    Thanks totalturtle - I have only had one payment so far - again only after threatening legal action (i did it by fax) and my second is now still outstanding after 45 days (do these guys not learn). Any way my point is that some of the older T&C say 45 days not 28 for payment.
