Hi
Humm, am quite sure the older T&C's (version 3.1) in Feb 2006 had 28days. The recent version 3.5 states 45 days unless I am mistaken. So my question is, does that mean the new T&C (45days) apply to those who bought the phone in Feb when the older T&C was in place, or does the new T&C version 3.5 over rides any previous versions? P2UD are not very clear on this and for a very good reason ( a bad one for all consumers).

Totalturtle, thanks for your story of hope
I am in exactly the same situation ... I finally managed to get my first cashback cheque (and my wifes) after threatening small courts proceedings. My 2nd cashback claim went in a few weeks ago.
The only thing I would add is DON'T use recorded delivery! ALWAYS USE SPECIAL DELIVERY. Recorded delivery is absolutely worthless if you ever end up in dispute with the post office. Special delivery has consequential loss insurance i.e. if thepost office lose it and then Phones2uDirect then say you are too late too cliam, the PO become liable. I've had things gone missing with recorded delivery before and all it proves is that it's gone missing!!
There's a thread about these people here too.0 -
Agree with shieldsy - always use Special and not Recorded delivery. Royal Mail basically provide no backup (apart from maybe a couple of books of stamps) is a Recorded item isn't signed for, but SD is fully tracked. You can also pay extra for consequential loss - that way if it went missing you could claim against the RM for the whole cashback amount (would probably be easier!).
I still hadn't received my 1st cashback claim by the time I sent my 2nd in. I therefore informed them of my intention to proceed to court action (after contacting them numerous times prior to this) - lo and behold a cheque for the first two claims arrived within a week of that! Only got the final claim to go in a couple of months - will certainly steer well clear of them in the future!
