  • Sorry to hear about your constant calls Mallyash. We are getting hounded by Santander but everyone else has been relatively quiet. I have turned the ringer off on the house phone so I dont have to listen to it and just check it every now and then incase somebody I do want to speak to has called, then I will ring them back. They have our mobiles which are also our work phones but they appear to have stopped ringing those. I really hope you Harrassment letter stops them from hassling you anymore.

    Typically my OPUS card has the smallest balance on it ( £1800 ). AA on the other hand ( £16k owed ) have been Golden so far, even with the help of Their DCA.
    Each time they call tonight I will press answer and place the phone down next to the T V speaker so they enjoy a bit of telly. It might make a nice change from the usual Fascist propaganda films they have been brain washed with.
    There are better things in life than worrying about money…like nailing a jelly to a tree for example.
  • Ha Ha that made me laugh !! Come to think of it I might try that one myself with Santander !! I will dig out the Radio Times and choose their Christmas TV listening for them this evening !

    From what Ive heard it quite often seems to be the creditors with the smallest balance that are the hardest to get on board, Good luck though, keep us informed of how you get on .

  • I certainly will do mate. I suppose they think that because the balance is small they might get a full immediate payment. They can carry on thinking;)
    Also if a creditor can sell on a debt to a DCA for a pound or what ever, why can't we as debtors buy the debt too. In fact I'll buy all your debts PG41 and you can buy mine. Ill let you have them all at rock bottom prices, a quid each;) We might both have to register a Mickey Mouse DCA company first though.

  • Here we go again:wall:,
    Capital are offering to freeze all charges and interest as long as I forward my bank statement and wage slips. I,ve already sent a letter to them stating that this is not going to happen as it shows preferential treatment as no other creditor has access to them or even asked for that matter. Its a joint account anyway and not obliged to communicate any information regarding my partners money affairs so end of. This row has been going on now for two months, if they would stop being awkward and pull their fingers out I would start paying the repayment as proposed. Untill then they can Jog on. Apparently the Lady on the Phone this morning said that If my DMP was set up and run by CCCS every thing would be fine and dandy. Because Its a self managed DMP I need to provide proof of Income. I told her to go a read through the Lending Code to which capital one are a singnatory and look at Common Statement, sections 204 - 212.( particulary 209 and 212 ).

    RBS on the other hand will only accept my repayment plan if provide a signature. Apparenty this is to confirm that it is me who is proposing the re payment plan. Who do they think it is Robert Maxwell ? Well I don't know how you people feel about this, but I'm under the impression that rule No 1 is 'Do not sign anything. I had a good 2 twenty mins on the telephone this morning to a fella regarding this and apparently until I provide an autograph either on the original CFS ( which is being returned to me) or on the letter recieved today, they cannot commence to put the payment plan into effect. Shame that as I was going to pay the first of the proposed reduced re payments this week. Can't be bothered now I'll spend It on a funkey new hair cut:kisses:.:p I don't know, you try your best with these people and they constantly place hurdles in front of you.

    Better news though, Both my Barclays cards have accepted my Plan, I recieved a nice letter for both today understanding my position and are stating that they are happy to help out, arr sweet:grouphug:
    Only Floyd's and the Puppets at Opus to go now and I can sit back and relax. ( Opus rang my home again last night at 9.35 pm. By this time I'd had one or two more glasses of wine than I realy should have. I would imagine now that relations between myself and OPUS might, well should I say be rather 'Fragile'.:whistle:

    I can say that the whole experience of pulling my head out of the sand and doing something positive about my Debts has been ' enlightening'. I would and could not have done it with out the help of the brilliant People who post on here. What I heve learned Is that Its only money at the end of the day. No ones going to prison or coming around your home to kill you. Creditors with out County court judgement have about as much authoritory to demand payment from you as the Milk man and use their debitors lack of understanding of what can leagaly be done and can't against them.Saying that though, from personal experience most creditors are willing to help you get out of trouble and If they are not, Knowledge IS power. And thses forums are full of helpfull people with oodles of knowlege and I thank every one who contributes to it. Happy Chrimbo.:xmassign:

    Well done I wish I could get the same result from halifax each time i ring them to ask to stop interest or at least reduce I just get the answer they have to charge 1% of amount outstanding. Do you have any tips on what I should say or any templates of letters. It would be much appreciated. Thanks

    Well it took ages to get them to accept of DMP as we had used the CC within 28 days of commencing DMP with CCCS. So for 2 months they added interest (increased interest rate as they stopped our special deal) and loads of charges. I wrote a complaint letter just stating that as we were in hardship they should treat us fairly etc. I received a letter asking me to ring them. I did this and again stated that i wished to make a complaint as they were making my situation worse and that if it could not be resloved i would take the complaint to the FO. They agreed to refund all interest and charges for past 2 months and even paid me a £25 compansation payment. The bloke on the phone stated that they could only reduce interest rate to 1% per month. When my statement can through it showed no interest due for following month and the next one the same. Hopfully this will now carry on. Best thing to do is ring and say that you wish to complain against the treatment you are receiving and go from there. Hope this helps.

    I know I'm quoting myself - how vain :rotfl: but, I wanted to point this out to 2spicy and the others discussing this and say, isn't this all confusing. My understanding is similar to 2spicy's but I'm really not clear about it all.

    Who's your provider spicy?

    Were with Payplan.
    In duscussion with our advisor, we can make an offer to any creditor at any time to settle the debt. We donot "have" to offer each creditor the same or a divided portion of the total.

    The understanding being, that when one creditor has been settled, the total monthly amount for each remaining creditor should increase.

    Was advised that if we wanted to make a settlement offer, to contact payplan who have a settlements team who will try and negotiate a "Full and Final" figure on our behalf (which may be less than the outstanding balance, but a sum that a creditor is willing to accept as full settlement of the debt) .. this it would leave even more in the "pot" for the remaining creditors to have shared out between them.(if that makes sence?)

    I noticed no one has replied to your post. Have you sorted this out yet? If you haven't had contact with your creditors for a long time they may have written the debt off especially if it wasn't for a large amount.
