  • Well, we're waiting for CCCS to set the wheels in motion. We've given CCCS all the info and sent the first letter out to the creditors around 12 days ago. The reactions have been interesting (from those creditors we've heard from):

Virgin MBNA CC - cut up your card, if you wish to know why we are asking you to do this then ring us (sent twice)

Halifax (OD and Loan) - tried to catch me on the phone a couple of times and sent a letter reminding me about OD fees.

Tesco CC - thanks for your letter, here's all the details your company (CCCS) will need from us. We will now officially default and close your account.

Mint CC (most bizarrely) - no reaction to the letter but they've sent me a new CC...!

The others (there are many) we've heard nothing from.

    Redetermination update number 2!

Well...this one went even better! - Nationwide wanted £120pcm on a balance of £2400 OR by way of a CO (which they claim they would not enforce) they would except my offer of £29.49.

Judge was awesome! - told Nationwide solicitor straight away that he bases all his judgements on income/expenditure - always has done and never had one go to appeal! - Solicitor tried to argue but Judge got cross telling him we had done all we could, shown willing through DMP and best of all stated he would not accept this aggressive behaviour from a creditor and in no way would make them preferential.

CCJ awarded in my favour but best bit was..

Nationwide claimed court costs - Judge said why would he award court costs when they had lost - brilliant - solicitor was knocked for 6!

Today - common sense prevailed...tomorrow who knows!

    Me 2 - Nationwide 0

It must have been hell going through this farce, when all the time common sense was staring you in the face. Thanks for all your recent useful posts on your experiences. Let's hope your DMP will settle now so you can get on with the business of decreasing your debt in a fair and reasonable manner.

Great news. What a complete waste of time & money not to mention the stress it caused for you.
    Well done.

    Hi

I am looking for advice please

My husband has just had a ccj from Natwest and even though we completed the forms with an income and expenditure showing we can only afford £75 a month the courts have set the amount at £979 per month! we have a redetermination hearing on monday is it likely that they will change the £979 monthly repayment?

thanks for any help anyone can give

Can't offer advice but again its a learning curve for me to hear from Grantalein that the court could have set this amount possibly without even having your income/expenditure!!
Good luck for next week and let us know the outcome.

  • Well finally had my lightbulb moment and after trawling through the DMP threads I took the bull by the horns and contacted CCCS today. Did the online debt remedy and have proceeded after being advised to go on a DMP so will hopefully get my pack in the post soon and get the ball rolling - such a reflief although not looking forward to the backlash from my creditors.

How long does it take to get the DMP up and running once my pack comes and I send in all the paperwork?

I have just realised I forgot to put one of my creditors on the list when I did the debt remedy test, can I add this when the pack arrives or is it too late now?

My initial DMP details suggest £479 to pay my creditors over about 3 years which I was quite surprised about given my level of debt so woohoo - will this change though once I send all the paperwork in and the CCCS contact my creditors?

I feel like I have a thousand more questions but most of them have probably already been asked and answered on here a million times over so will take a proper look around - well done on such an amazing and helpful thread guys :T
    Total Debt £14,000

CCCS finally contacted for DMP Nov 2010, time to move towards being debt free :D

Well done on the lightbulb moment.
I'm still learning but one thing I have picked up is that creditors behave different ways to different debtors so who knows exactly what will happen. Some people are bombarded with letters and calls others are not.
BUT you are on the right track and as things occur you will get loads of advice from folks on here who quite frankly have got me through the first few months.
    Good luck:)

  • Quick update from me. Still waiting for CCCS to put the plan together, this is due to complications with my partner's pay history (not least finding out he's been on the wrong tax code since April - thanks to the new tool on this website).

Most of the creditors are quiet. We're getting one phone call a day from Barclaycard who are completely ignoring the letter sent and the postal order.

Surprisingly we've also received a really pleasant and helpful letter from the Halifax... maybe they're lulling us into a false sense of security!

The most bizarre has been Mint, who've issued us a new credit card. Now shredded.

    Onwards and upwards :-)

I have just recieved forms from CCCS still need to sign and send of bit's and bobs.
I have always paid min payment to cards but only by borrowing from one card to another so it has totally spiralled out of control.

Have approx 38k of debt which will take about 14yrs to clear if not longer if interest isn't stopped:eek: .
Real LBM was on monday when i worked out that out of 1123.81 i am paying to cards each month that 663.73 of that is interest and with the best will in the world no amount of ebaying, carboots or even trying to sell my body lol! will make the slightest dent in it.

I have today paid min payment to barclaycard as wasn't sure what to do about token payments etc but a couple of payments are due next week and unless i borrow off cards again am not going to be able to pay! what a mess.

I have applied for a nat west step account (as one of the main CC is with the dreaded lloyds tsb who i bank with!) so untill that is set up feel a bit in limbo.
Not sure what to do next it all feels a little overwhelming (sp) and it looks as if i am here for the long haul!
  • I also meant to say, for others that might be considering the DMP route, that we dithered about taking this step for months and months, all the while spinning out of control.

So far, all in all it's nowhere near as scary or as complex as we thought it would be.
  • Mom23,

We're only just ahead of you on this. Both our DMPs will probably start in Dec. We also have around similar debt levels. It is awful realising how much you've been getting screwed for interest, for years and years and years.... But the main thing is that we're now trying to get things into control.

We're sending minimum payments via postal orders at the moment. Our new account is with Santander - we didn't have any defaults etc (as we'd been bouncing between cards to live off and pay the minimum every month) but were surprised when they took us!

I think the limbo feeling is understandable - we feel a bit like that too. We just need to hang in there, keep making token payments and wait for CCCS to do their stuff
