my daughter turned 18 just 2 week ago and yesterday walked into phones4u and was sold a contract even though she has no credit history,on the paperwork it says that her proof was a credit card although she has a debit card and it was a debit card she showed them she isnt working and only gets ema yet they ticked the box that says working s that legal?

She is now into a contract, she wont have been miss sold a contract, as they discuss how many mins, texts and internet she would get.
If she provided false information to gain a contract i.e saying she works, its going to be even harder to get out of the contract.
Having a credit card is not proof of age.
you have 7 days to return the phone.

You only have 7 days if bought on line of via the phone. For anything bought in store you have no cooling off period.0

Two things really.
1. You could argue that your daughter willingly took out the contract and had therefore provided false details to obtain one. She is 18 after all, and can now make decisions for herself.
or
2. The sales person was over zealous at ticking boxes and should be reported to his/her manager for mis-selling and not checking details thoroughly.
Either way, if the contract is not needed, I would get back to the shop sharpish and claim point 2.

You don't need credit history to get a phone contract.
I got one at 18 with O2. Now I am 21, and have a 0% 10 month CC with a £1100 limit

Your daughter is 18. The law says she is allowed to take out contracts in her name and she is responsible for her own actions.
The debit card bit would have simply been an identity check.
It sounds like she lied about being in work.0 -

Just be thankful she didn't do a Cheryl Cole and get the name of her fella tattooed on her neck or somewhere even more visible now she is 18.

I think most people are missing the point, the OP was asking if what happened was legal and parallax pointed out it was either her daughter or the shop lied/was overzealous (2 weeks ago).
She's got a phone with a contract which she is legally responsible for - if she's wanting to get out of it she'd have to prove she was mis-sold the contract but it would be a difficult battle, I suspect.0
