Thanks for the explanation via PM/Email - all makes crystal clear sense to me - now time to explain to you, what to do next. Basically all the advice that follows is a step-by-step process and needs to be followed to the letter, in order to work through this, and save you loads of money as well.....
Ok, remember your partner will be doing all this using her address as on the credit file, do not do any of it at your address or it will create a link so stick to the address currently being used (her parents or whetever it is)...
You'll start by sending a SAR to each lender, doing this will allow you to sit and work out the charges that have been applied over the last 6 years, by doing this the debt will reduce significantly, afterwhich we'll look at making F&F Offers dependant upon the balance after the charges have been refunded.
So following the processes below will allow you to do this the correct way:
Step 1
HSBC:
Send a SAR to them (with £10), quoting both account numbers (the bank and card): SAR Request - Advanced Version
HBOS:
Send a SAR to them (with £10) quoting the account number: SAR Request - Advanced Version
Then wait the statutory 40 days, they will reply to the address on file so keep checking post, cos they may write asking for a signature, if they do you'd then come back to me and i'll provide an additional template to send back.
Step 2
Once you have worked out the charges, from the data supplied in the SAR packs you need to go to the relevant link below and follow the processes within them, in order to get the charges refunded (to the account):
a) - For Credit Card charge reclaim - http://www.moneysavingexpert.com/reclaim/credit-card-charges?dd
b) - For Loan charge reclaim - http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance?dd
c) - For current account charge reclaim - http://www.moneysavingexpert.com/reclaim/bank-charges?dd
Step 3
You should by now have had offers to settle the charges from the lenders - once you accept them, and they are applied to the relevant accounts you'll have a new grand total for each lender. It is at this point you'll come back to me and i'll advise what to offer each lender as a full and final settlement figure. You cannot do this right now because of the charge reclaims.
Typical F&F Template (for reference at this stage) looks like this: Default Removal - Offer of F&F Settlement
Remember to treat HSBC as two accounts for everything, other than when you request a SAR (a SAR is everything they hold about you, not account specific).
Hope this all makes sense, it is quite easy once you get started, however it does take time - lots of time! Just remember do not ever speak to them on the phone, you must only deal in writing by following the processes above - if you deviate you could cause more damage than good! Just PM me if you get stuck, i'm usually here at least once a day and will reply when I hear from you (you could always email)....
Good Luck - does it make sense to you? :beer:0 -
Anonymousa wrote: »Thank you so much. This makes complete sense, BUT... we don't have access to the post at that address. Her debit card is registered there so I think we can do a divert via Royal Mail. This won't create a link (will it?)
Hiya
why don't you have access? I thought it was her parents address? However, yes do a mail divert - you'll need to get at least a 6 month one though cos things will drag on and you cannot start talking to them, you must stick to the process above....
Oh, and do not pay anything until this is sorted - they cannot hassle you, at your address so it should be fine.
It'll take a while to sort but soon enough you'll get it done and this will be a distant memory, I mean you could pay the full balance now and walk away - however do it my way and for 6 months of letter writing now and again, you could end up £8k better off - to me it's worth fighting my way for a bit....
But up to you really.....2010 - year of the troll

No her parents address is the one before that one! They do have her parents' address on record. Sorry that I wasn't clear on this - I tried to be as clear as possible.0 -

I edited my last reply - you are too quick for me! haha
Sorry ok - well then do a mail divert - it'd be best to pay for a year one cos it may be hard to renew after 6 months........ have a look into it, but this could take a while to sort out....2010 - year of the troll

Right best of luck, have fun and remember you're in control - not them! Just play the game, follow the advice above and you'll be clear of all this before you know it!
You have my email, should you need to keep stuff off here or email me things. Chat later :beer:2010 - year of the troll

However; problem already. We can't divert from the address on file. She has no record tracing her there currently or for the last 6 months, and even though she can come up with the landline number, they (Royal Mail) can't place her there, so won't divert the mail.
Therefore, we will go to a RM office and see if they will do it, but they also pass on the address and they return mail informing the returnee of the redirected address if the mail says "do not redirect".
Could we use her next address (which is one ago) - I'm not sure if this is an option? We could use her parents as well, but we want to keep them uninvolved if possible, though I've told her we're likely to tell them this week!?
Last question - if we go ahead and use her parents' address and bailiffs turn up there (for whatever reason) can they say "she doesn't live here" or have we put them in real difficulties?0 -
Can we do it from a PO Box?0

For purposes of update, I want us to use her parents address to deal with the debt. I don't want to create a financial link between me and her because when we renew our mortgage, it is in my name. She is resigned to her credit rating being obliterated.
I love her very much; I think we had a stand off this evening. Mrs A is ashamed, and is embarrassed at telling her parents. I think her parents know (if I knew in 9 months or A LOT less, they know). But I am insisting on being there when she tells them. Mrs A is upset. I want to get on with it, but it looks like we need to use her parents' address (from other areas of the site, bailiffs are a long way off).
She has finally started to talk to me, but I want her to start to lead (I don't necessarily mean "decide" or "sort out", but I do mean gain some urgency) things.
I found it hard tonight. I cried twice and can't sleep. I don't blame her, but I need her to be the woman I love and be (or act) strong so we can have started this before our child is born.
That's all.0 -

Hiya
Thanks for emails - I agree, this is the best course of action and you'll (her parents) will hear nothing from bailiffs. I presume you're using c/o @ parents? Make sure you do, this also confirms that bailiffs would be wasting their time as it is simply a c/o address.
No, PO boxes are not much use to be honest - they can be, but really there is no need cos long term you will have this sorted, and Mrs A's credit file will only be trashed for the next 3 years afterwhich she'd be fine, i'll explain more about this as and when it is pertinent... don't want to confuse matters right now, but after you've sorted the reclaims we'd be going for a F&F offer and as the template showsm part of that is to haggle for default removal....
Stop letting this work you up, its really no big deal and the amounts are relatively small and you have each other, that is the main thing - don;t worry about this, it's easy to sort and will be a distant memory this time next year
Chat later - best of luck.2010 - year of the troll
