Hi January, what a complete shambles!
So the bad guy gets off scot free and the good guy is out of pocket - unbelievable!
Hope you left them a BIG fat juicy neg and from now on to be on the safe side, always send your items with tracking so nobody can pull this stunt on you again

I haven't left them a neg yet but I am going to. I want to think about what I want to say and how to word it
I am definately going to send with tracking from now on, but I don't think it would have made any difference in this case as I reckon Paypal would still have sided with the (fraudulent) buyer.:rolleyes:0 -
Why not take him to small claims court. Yes it costs £25 but I don't see how you would loose ?
Threaten him first see what he does.Nice to save.0 -
I'm going through something similar at the moment, with a dress that was perfect when sent out. I'm sure the buyer just didn't like it and thought they would damage it to get their money back. They have claimed twice that it's been sent back but paypal have given them 10 days to supply proof of postage. Note, not proof of delivery, so I'll probably never see it again.
I was going to try and file a fradulent claim appeal but if you need a crime number then I'm sure it won't get anywhere.
It's so frustrating. The fact that paypal are so hard to contact does not help at all. I am going to stop offering payment by paypal now.0 -
heres a question for you , why would you damage the book before you sent it, you would lose out anyway coz there would do a chargebackNo Links in Signature by site rules - MSE Forum Team 20

Refuse to accept it with paypal. I did and they overturned mine.
Phone paypal yourself, and speak to somebody. Over the phone they will have no opportunity to just dismiss wha you are saying. It worked for me.
Explain to them exactly what has happened and that you can PROVE that he is lying. Tell them that you are unhappy and will consider action against Paypal also if they will not help you. Ask to speak to a supervisor if the idiot wont help.Be nice0 -
I'm so sorry, poor you. I hate it when people get away with it. This seems to be happening on Ebay now, changing one item for another. Disgusting.
Can't give any advice though...
I only had to do a chargeback once. It was all going well, apart from quite evil emails from the seller, until the RM forgot to get a signature on the recorded delivery when I returned the item. I know the seller got his item back, I got my money back from the RM (!) (they knew it got delivered, but refunded because they did it wrong) and the original payment I think was kept by PayPal!! as the case never really got concluded, due to the missing package. I wasn't going to ask the seller if he ever got the money but he never sent me gloating emails, so I assume PP kept it.
Nice people.:wall:0 -
I just wanted to sympathise with the OP. What a frustrating story - with the moral of the story appearing to be that the scammer always wins in the end.Overpay!0

This person has got away with this and while only a small amount was involved this time, next time it could be for a high value item. There is nothing stopping this happening again and I am shocked at how easy it is for someone to commit fraud and get away with it.
That is very annoying and the buyer is basically a thief to do that. I am sorry it has ended this way. Has Paypal at least told the buyer to return the book to you before they refunded???I

Hi everyone,
Thank you all for your input on this matter.
Paypal did ask the buyer to return the book but he had damaged it even more, gluing some some of the pages together! I told Paypal that he had returned the book to me damaged / not in its orginal condition and they still refunded the git  .
I will try and phone Paypal again, I tried a few times before but could only get an automated service, not a real person.
Don't think its worth going through small claims as the book was only £9.99. Though it is tempting to see what his reaction would be!0
