The buyer who says I sent him a knackered book bought a selection of books including my title the day before he purchased mine. The auction states that some of the book have identical spine damage that he is saying occurred on my book. Odd or what? :D

Have you pointed this out to him? I most certainly would. I'd tell him that you noticed he purchased the same book from another seller which was listed as damaged and you still stand by your belief that yours wasn't damaged at all.

Did you mail them? If not mail them and tell them to take a hike!

I'd put the link in for the damaged book listing and tell them to try it on with someone else.

I can't believe some people can be so sneaky and stupid at the same time!
Tank fly boss walk jam nitty gritty...
  • Thank you all for your replies and advice :)
I e-mailed him pointing out everything right before I posted here last night. I've also contacted eBay and Paypal about this as he is now trying to get a chargeback.
    I await any response.

Maybe he got the sellers mixed up.. strange behaviour to buy a damaged book and a good book at the same time.

However something I thought of, if buyer now says he got the sellers mixed up and now realises the damaged book did not come from you. He can claim non delivery of your book, so unless you can prove delivery...maybe his charge back will be successful

The police will not go through someone computer for £9.99 fraud :rotfl:

The police only cease computers on more serious crimes , if it was me i would forget about the £9.99 and refuse to refund , if he makes a complaint to Paypal state to Paypal about your concerns.

Seeing as he as admitted to receiving the goods then he cant claim on them grounds.

Also i think the Police do a good job and they were really great with me and i couldn't belive how fast and professional they dealt with me.

Sorry to hear that they didn't take your mugging serious as im quite shocked to hear that

I never said anything about seizing a computer. They wouldn't have to sieze the computer all the evidence would be readliy available, without anyneed to seize computers. And if you read what I said I would expect an apporpriate course of action would be to visit the offender for a "chat" and a warning. However, subsequent information came to light in the thread which would give the offender a good excuse, namely that the buyer bought 2 books 1 badly damaged 1 good condition. The buyer could easily say they made a simple mistake and were complaining to the wrong seller about the condition of the book.

    So what happened OP?

I have been threatened before by someone claiming they had a knife and would stab me. I was trying to stop a friend from being mugged.
The police said that because the guy had not actually pulled a knife and had not taken anything off of me they could do nothing.

DO NOT watch Traffic Cops on BBC1. It's a good show to watch, full of drunks, stupidity and people getting hurt/killed. Then you get an update at the end, and 3/4 people get away with all sorts of crimes - the only people they seem to 'get' are the drink drivers. All shootings, muggings, beatings are let off the hook.

OP, just wanted to say I hope you are sorting it all out, what a nightmare

I put a statement in my description, saying 'all sales final'. I send my parcels recorded, so it can be claimed, if they don't receive it or if it was damaged.

Sometimes the Post Office can be very careless and should be made to pay.

In your instance, I feel the person is pulling a fast one.

You get all sorts on ebay

  • January Embers, you and I might know perfectly well that the police are unlikely to take any action over this petty crime, but does your buyer? If you report it to the police and get a crime reference number, that should be enough to persuade them to back off and drop their claim. Also, as Wig pointed out, it's worth reporting crimes if for no other reason than to help towards accurate statistics, which may help with crime prevention.
Alternatively, you could take the diplomatic approach and point out that the buyer has evidently made a "mistake" and confused the book you sold them with the one from the other seller.
I've only had one complaint about damaged goods, when I sent a video in an ordinary jiffy bag. The buyer sent a message through eBay saying that they were very disappointed that I'd sold it as new when it evidently wasn't because the case was damaged, and they'd bought it as a gift but it was unsuitable for that purpose because of the damage. I replied assuring them that it was new and in perfect condition when posted, and offering a refund if they wished to return it. I got positive feedback simply saying "Thanks", and heard no more about it.
  • Heres an update on what has happen with this:
      Paypal refunded the buyer
    • I appealed
    • Paypal told me I had no grounds to appeal  but I could report the claim as fraudulent. To do this they tell me to go the police and get a crime number.
    • I go to the police station with everything related to this case and they tell me, 'no crime has been committed and it is a civil matter' so they will not give me a crime number. :(

This person has got away with this and while only a small amount was involved this time, next time it could be for a high value item. There is nothing stopping this happening again and I am shocked at how easy it is for someone to commit fraud and get away with it.
