I have checked my credit report again today and the CCJ against me is still on there. This is after me receiving a letter from Severn Trent on July 2nd (dated June 16th) stating that they had sent a letter to the court to remove it. I rang the court to find out why it had not been removed and they said that they have not heard anything further about the account since Feb!
Another phone call to Severn Trent, and again told that the documents were sent in June. I told them what the court had told me, but it was only after my prompting that they said they would resend the documents to them. They said the court hadn't updated my file yet because of a backlog, which surely the court would have advised me if there was that possibility.
I was going to leave it, but I think that I will put a complaint in writing about all this, as it is now nearly 2 months after they have admitted the error and that big black mark is still showing on my credit file::: Total Paid Since LBM (27/05/10): £4639.85 Official Debt Gone!! :T ::::AThat money talks, I don't deny, I heard it once, it said "Goodbye"~ VSP2011: #104 ~

That's annoying about the CCJ, hope they get it off your report soon. You should definitely make the complaint.

I got really upset yesterday. The mortgage payment has gone up this month by about £20, and I'm not sure why. I can't get in contact with my ex, and I'm tied into my rent agreement until October. So I'm having to pay both mortgage and rent for at least the next 3 months. We can't afford it. By the time I get paid this month, it's not even going to take me out of my overdraft I don't think
We can only afford one or the other - either we keep the house and move back, or we stay renting and I stop paying mortgage and get the house repossessed, which will kill my credit file.
OH and I had a sit down and a talk last night, and we know that the most logical and financially sound thing to do is to move back to the mortgaged house.
- It's closer to both our work places and will therefore save us about £50 each on petrol each month, not to mention that it will only take about 5 mins for OH to get to work and 15 mins for me.
- We will be able to get cable again and will be cheaper than our current broadband through the phone line as OH can get staff discount.
- We can do what we like to the house decorating-wise without having to ask permission from a landlord
The main problem is that ex is still going to be on the mortgage. Until I get his name removed, I will not be able to sell or do anything without having to go through this ridiculous amount of hassle and stress. He wants his name off it, but he won't pay anything towards the solicitor to get it removed, and he won't send the solicitor proof of ID either. It's going to cost me hundreds to get rid of him, and it's just all getting me so down.::: Total Paid Since LBM (27/05/10): £4639.85 Official Debt Gone!! :T ::::AThat money talks, I don't deny, I heard it once, it said "Goodbye"~ VSP2011: #104 ~

God your ex is a complete idiot! Why won't he send proof of id if he wants to be taken off the mortgage? I want to go round and slap him myself
I know it's not nice for you, but I think I would be tempted just to try and save up the money from the savings you make by moving back to the house, just to get him off the mortgage and have him out of your life. But then I suppose that doesn't solve the main issue of him not providing id does it?
Hugs to you, and hope you manage to get things sorted out."Good financial planning is about not spending money on things that add no value to your life in order to have more money for the things that do". Eoin McGee0 -
Thank you Jwil. If I can find out where he lives, I'll pass his address on to you too lol
(I'm sorry if it's seemed like I haven't acknowledged your last few replies properly - I wholeheartedly apologise!)
I've called the solicitor for the sale today and closed the case. I spoke to the buyer and he told me that his solicitors have already done this. He's said that if I'm able to get ex's name off and still want to sell, he will still be in the market to buy in the future, so that's good to know when I do get his name off itHe's also suggested that I could sue my ex for his share of the mortgage payments for the past 3 years, which would come to around £10k! That would be a nice slice to get back
I shall be looking into that... *evil grin*
I've also discovered why the mortgage payment has gone up this month. Although I got my insurance company to fax over a copy of the insurance schedule, they haven't actioned it and have added their own insurance to the mortgage payment! They said they are going to cancel their insurance and refund the amount towards the arrears which is fine by me as I know I need to clear them asap.
Me and OH are going to go round to the house this weekend and start sorting it out ready for us to move back in. Going to give the living room a lick of paint while the rest of the stuff isn't in the way. OH and dad are also going to get some of the bigger jobs done while the house is empty, like sorting out the back room.
I'm thinking about downsizing the sofa as we currently have a lovely leather corner suite, but it has never fitted properly in the house (though it fits absolutely perfect in our rented house lol). Thinking of changing to a 3-seater, possibly a 2-seater, and an armchair. If we can sell the current one and get a cheap new one, even if it's 2nd hand, I think it will make the place feel more like "ours" rather than "mine and the ex's"::: Total Paid Since LBM (27/05/10): £4639.85 Official Debt Gone!! :T ::::AThat money talks, I don't deny, I heard it once, it said "Goodbye"~ VSP2011: #104 ~

I didn't give the best news though!
Me and OH are now officially engaged! He got his overtime through, and has (unbeknownst to me) used some of that to buy a ring that I'd said about a few months ago. We went round my dads house last night, and he got down on one knee and proposed :blushing:
He did said he felt guilty about using the money on that while we were going through all this turmoil at the moment, but in all fairness (and I know this is bad of me) I don't care! I love him to bits and it made me so happy after the crappy days I've had recently. :happyhear::: Total Paid Since LBM (27/05/10): £4639.85 Official Debt Gone!! :T ::::AThat money talks, I don't deny, I heard it once, it said "Goodbye"~ VSP2011: #104 ~

Yay on the engagement! :j:T:j:T
Congratulations to you both
You need some good news after all the hassle you've had recently, so good for your OH.
I think you should DEFINITELY sue your ex for the mortgage payments, it might give him the kick up the !!!! he needs to sort out getting himself off the mortgage!"Good financial planning is about not spending money on things that add no value to your life in order to have more money for the things that do". Congratulations! Thats fantastic news! :jDebt free date - 4th December 2008 :j0

Thank you both!
Though the hassle never ceases it seems... I've checked my credit report again today, and that CCJ is still there...
I've got a letter dated 16th June that says they are going to remove it as an error, but the courts still say that the last they heard from Severn Trent was Feb 2009. I've put in a formal written complaint with them today, and also sent it to Consumer Council for Water.
I need to get this gone as soon as possible as I reckon I will need a loan to see me through the next few months while we move back and have to pay both mortgage and rent.
I will be so glad when all this is over!::: Total Paid Since LBM (27/05/10): £4639.85 Official Debt Gone!! :T ::::AThat money talks, I don't deny, I heard it once, it said "Goodbye"~ VSP2011: #104 ~
