When (if) Apple ask for it back then they can come to some arrangement then (with this paperwork that you are so hungup about). Where did I say they need to be proactive in sending it back?
Can the OP prove to Apple that they said they can keep it? This is exactly what they would need to rebut Apples demand for it back in future.

I also would suggest he held onto it for while before using, but he can't keep badgering them to get it in writing.

OP asked his rights. At this point he has no rights and in fact Apple have legal rights to the Ipod back. He must to ensure it is his to keep get something in writing.
The end.
I foresee a post in 6 months wherre OP is complaining about Apples debt collectors demanding the cost of an Ipod.0 -
