Apple probably havent written it off though, they will have claimed from RM for it.
When RM contest this just wait for the letter to arrive.
Can the OP prove what Apple said? One would suggest if they cant then they could easily find themselves in a sticky position when Apple or RM start getting upset and alleging dishonesty.0 -

Urgh, what stupid reasoning - I'm sure I've heard such logic used shortly before fraud being committed.
OP, wait until Apple confirm in writing and then it's yours to keep. Otherwise, if you cannot prove what Apple has said and you have only paid for one, you should just cover yourself by keeping the other handy in case Apple ask for it back (which of course they can do until they confirm otherwise).Thinking critically since 1996....0 -

If the alternative is being with you condoning corporate or benefit fraud because 'they can afford to lose the money' then yes please, where do I sign?
The alternative is the OP takes your advice, sells on / gives the 2nd ipod away and then Apple come asking for it. If the OP cannot prove that Apple have said they can keep it (and they have only paid for 1 iPod) then legally they will have to pay for the second.Thinking critically since 1996....0 -

You are misquoting me, I said "I'm sure Apple can afford it, they probably never even mentioned it to the Royal Mail". Meaning that they didn't make a claim.
It is not fraud, why should the OP go to so much trouble, he has done the decent thing by phoning.0 -
And I am saying just because a company can afford it doesn't mean it is adequate justification to not do the right thing - I did take it a little out of context for which I apologise. I just get a little tired of reading the 'I got 2 of something due to a company's error, can I keep the second even if I didn't pay for it' type threads.
My suggestion was just to assist in the OP protecting themselves in the situation that Apple did come looking for the 2nd iPod. Phoning certainly was the decent thing but I'd still want it in writing.Thinking critically since 1996....0 -
