2 iPods for the price of 1?!

Hi,

I ordered an iPod Nano from the Apple website, who advised shipping in 24 hours, 10 days later I had not received it. When I called to complain, Apple told me they could give me a refund or despatch another by UPS (the first having been sent with Royal Mail). I opted for UPS. I also had a second separate parcel which had not arrived, and the supplier suggested I contact my local Royal Mail sorting office to see if they had it - turns out they had two parcels, but had not left me a caller card for either - one of which was my iPod which I collected (without signing for). Meanwhile (same day) I had a card left by UPS to advise attempted delivery of the second iPod.

I was going to just refuse delivery of the second ipod, but thought better of it and called Apple to explain the situation. To my amazement, they told me that they had written off the first iPod, so I should just collect and keep the second and give the other one away!!

So - can I really just keep 2 iPods when I only paid for one, and if/when does it become legally mine? I don't want to give it away or sell it, and then get stung for the price again later down the line...

(I really need to know the legal angle on this please, rather than a 'Doh, just keep it'!)

    Get in touch with Apple asd ask them to kindly send you an email confirming what they said.

    Yes, you can keep it if they said so.

    With any other company, the answer would be no, but Apple really don't seem to care, and I know 2 other people this has happened to!
    Should've = Should HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    If UPS paid out compensation for it then I would argue legally it is theres or at least until they are paid back any compensation payout.

    I read it as both were delivered and Apple 'wrote off' the 1st Ipod

    You read it wrong.

    Apple sent the OP a replacement because they thought the first one was lost.

    They likely claimed compensation from UPS for the "lost" ipod therefore its arguable if its their to write off in such a circumstance

    I would be surprised if the OP got a letter through the post from UPS or apple asking for a fee or similar when it flags up they have 2 ipods. Its even arguable it could be seen as deception by collecting the 2nd knowing it was "lost" and had a replacement.

    I would be surprised if the OP got a letter through the post from UPS or apple asking for a fee or similar when it flags up they have 2 ipods. Its even arguable it could be seen as deception by collecting the 2nd knowing it was "lost" and had a replacement.

    Apologies missed that. However it still doesnt change the fact it was sent by either recorded or more likely special delivery requiring a signature and insured.

    well thats dowjn to RM to contest
    if they followed their own procedures then they would have a signature to contest any claim for loss
    if they dont then they leave themselves open to a claim
    the OP has informed Apple of the mix up

    The OP would be foolish to keep it without ensuring Apple send a letter confirming this. No doubt a bank holiday cover person didnt fancy doing the work themselves today and told the OP this.

    the OP contacted Apple to state they didnt have the item
    Apples answer to this was to send another
    the OP has made Apple aware
    if it were me in that situation then i would consider the issue closed
