    Supply of Goods and Services Act 1982

    Requires the trader to use reasonable care and skill and says that any materials or goods must be of satisfactory quality, fit for purpose and as described. It also says that, unless a specific date is agreed for a service to be provided, it must be carried out within a reasonable time.

    Your legal rights when you buy goods

    When you buy goods (including goods supplied as part of a service), the law gives you certain rights as a consumer. The law says that the goods must:
    • be of satisfactory quality. This means that the goods should be free of any faults, including minor ones. They should be of the quality that a reasonable person would expect given the description, price and any other relevant circumstances. You can take into account the appearance and finish of the goods, and whether there are any defects (including minor ones). You can also take into account whether publicized information about specific features of the goods is accurate, and whether the goods are safe when used properly
    • be fit for the purpose. This means that you must be able to use them for the purposes that you would normally expect from this type of product, or any purpose that you have told the seller you want to use them for
    • match their description. This means that if there is a verbal or written description of the goods, it must be accurate. And if you choose goods after seeing a sample, your goods must match the sample.

    You are covered by the 'supply of goods' part of the Act which states:
    You are also entitled to expect that a service will be:
    • carried out with reasonable care and skill
    • finished by the date you have agreed with the person providing the service, or within a reasonable time if you haven't agreed a specific date
    • provided at the cost you have agreed beforehand, or at a reasonable cost if you haven't agreed one.
    As you trusted the 'professional' to take reasonable care over the measurements, which they haven't. Its important to point out they may claim to be salespeople not professional dressmakers, however by taking your measurements, they put themselves into the role of the 'professional' and required you to trust them.

    Sorry to hear what has happened to you...
    When you look at the measurements the shop has written down, have they ordered the correct size based on this chart?

    This is what I used to order my dress which was a US size 8 (UK size 12 in my opinion).

    If you tried the dress on in the shop and it fit, then they should have ordered you the same size you tried on! I wouldn't let them get away with it especially as they've got time to order you a new one.

    If the seams are that far out it doesn't seem like one size difference! Definately chase it with them and see what they say, you have plenty of time and they have their reputation to consider.

    I got the call from the shop on Thursday to say my dress is in and I'm going in on Sat.... And that is my worst fear (to try it on and it not fitting!)

    If the seams are that far out it doesn't seem like one size difference! .

    If it was there should be enough in the seams to let it out.

    Hi guys

    Well ive been on the phone to the shop today and im taking the dress in to try on with them on Thursday afternoon. Luckily my mum is coming up from Birmingham for a little moral support, as i was dreading going on my own.

    The lady on the phone was very nice, obviously she couldnt say much without seeing it first, but im hopeful it will get sorted out.

    It was definitely a US8 that i tried on in the shop that fit, and the dress i have is definitely a US6.

    I think they measured me wrong to be honest. She did it while i was standing at the till with my clothes on, and she was so quick id hardly noticed that she'd done it! At the time i wasnt concerned as i assumed she'd be ordering the size that we'd all just agreed was the right fit except for having the bust taken in slightly.
    A verbal agreement with 2 witnesses is almost as good as a written agreement isnt it?!

    They've got me down as a 33.5 inch bust, mine is 34 over the top of my boobs (is that where you measure?), a 27 inch waist, which would be a miracle as ive always had 31" jeans and 37.5" hips which again is a little under my 38" hips.
    On the size chart, from those measurements it seems a 6 would be a good fit, if it wasnt for my waist and the fact that even though it says a size 6 bust is 34.5 its a hell of a lot smaller that that on me.... i think my back is wide.

    Had more nightmares about it last night and woke up with 3 whopping coldsores on my mouth from the stress and worry!

    All the best to you - am sure they will be much nicer than you think - as Size 8/10s are quite popular sizes, I'm sure they will try do something for you rather than have you rubbish their names!
