Do I have to refund?

I sold a phone to a buyer on Amazon UK. He paid late Sunday night so I never got the email until Monday Evening. The phone was posted to him on Wednesday on my next day off from work and he got it today (Saturday). He then sent me this email
sorry to say that i have received the order i placed but due to the time it took to get to me i ve already acquired a new one and so will not need this one. unfortunately though, i can see a return address on the invoice so dont know how to return it. can you please give me a return address. Thanks.

Now I never once said I would send the phone on a next day delivery and this was my ad.
No longer needed as contract has come to an end. On the Voda network. Not to sure if it is unlocked. Comes with Charger, 8gb memory card, box and instructions. Very good phone but not keeping as I now have the iPhone

Now all this is true and everything I said in my ad was in the box.

I never offered Next day delivery on the phone. I am sorry but I am not able to offer a refund for the phone that was bought in good faith. As the item is in working order and as described I am not obliged to make offers for return of goods. The time taken for the item to arrive was well within specified limits, which in this case was 5 working days.

    Do you think you might get a neg,
    if he kicks up a stink and as long as you dont mind offer to refund him less any costs you have had.
    It might save you getting negged and you wouldnt lose any cash.
    make the most of it, we are only here for the weekend.
    and we will never, ever return.

    I am not bothered about a neg to be honest. I dont have the money to refund. As I needed the money for something else so its already spent on that item

    There is a good chance that Amazon will force you to refund. People moan about Paypal always being on the side of the seller but they have nothing on Amazon. If they open an A-Z claim you will have no choice to refund

    All Amazon sales require you to post within 2 days so expect a warning from them

    I accept that but I still got the item to the buyer within a acceptable time.

    And the delivery time is more then 5 days. When I have purchased on marketplace it gives me a 2 week window. No where does it state the buyer must get it in 2-3 days

    On Amazon buyers can have a refund for any reason, so be careful. If this goes to an A-Z claim Amazon have been known to refund the buyer (with sellers money) and not even wait for the goods to come back.

    This is not ebay, and as others have said Amazon are much stricter and do not differentiate between business and private sellers, all buyers are entitled to a full refund as long as they let you know within a certain time frame (14 days I think) of receipt of item.

    EDIT: Yep, your buyer can have their refund according to the Amazon help system:

    Where you are withdrawing from your purchase within the first 7 working days after delivery and there has been no error on the seller's part, the seller will refund the cost of the item and the cost of sending the item to you

    I know with my own selling account I have had stuff returned after a week ro so on the basis they don't want it after all, and I've always refunded in full on safe return of the item.

    No but it does state items must be despatched in 2 working days. I think it could be argued that was Tuesday not Wednesday, although lif it was amrked as despatched 'late' then the seller would have had the late shipment warning which OP didn't mention so I assume the third working day is sufficient for the 2 working day despatch.
