Please bear in mind that it's not that easy to get a high ltv mortgage on a newbuild right now and a lot of lenders take unkindly to builder 'incentives'. Sorry to shoot that idea down but it might not quite work out like that. Plus, a few years back (perhaps changed now) you had to part ex 'up' quite a bit on the house you were part ex-ing if you see what I mean? So you part ex a £250k house to buy a £350k house.... I think therefore, unless it's all changed again, part ex-ing might not be a go for you.
The other two options are good though...
Are you sure the NFH won't trash your place while you are not there? That would be my worry esp if they find out you are trying to sell.
part ex;s normally require a differential of 25-30%. How would the lender know about the builder paying stamp duty?
On 250k it means purchasing a property for 325k0 -

I was thinking that you did not have any spare cash due to the fact you are saying you only have 3 months left financially in current situation.
If family can help would it not be better to sell at a loss and ask them to help with the balance to the lender? You can then start from scratch again.
I'm not sure about how the lender would pick it up re stamp duty. Someone else might be able to help there. I just know I've read on the mortgage forum that lenders do not like 'builder' incentives like deposit paid etc. Also there is the high ltv to consider - newbuilds only tend to attract around an 85% ltv mortgage at the moment - while you can get a mortgage for the £310k, it depends entirely on the lender's valuation at the end of the day on what they'll lend you for it.

Hi Miss Messy, came back to check the updates. Glad to see you're looking at some of the options/suggestions. Apologies in advance if my post to bouche upset you, was just trying to clarify that sometimes fighting to the end is not worth one's sanity/health/safety.
The NFH will get their comeuppance one day...what goes round comes round. Mega hugs, and please keep us posted.

Ok new revised checklist!!
At same time continue looking for part ex.... I had thought of looking at part ex's in a wide area as i could always rent out the new build for 6 months and rent where i am then sell on again.... get housebuilder to pay stamp and legal fees... even if house is inflated at least its better to get away ?
Not sure if its something youre still considering, but the offers on px DO vary. Bellway couldnt make the numbers work for us (due to falling house prices and low equity) to get 15% deposit we'd need to progress on a new house. The builder we went with in the end took our house in px and gave us £30k more than they sold it for, and knocked £10k off the asking price of theirs (I'm not daft - I know it shows just how much bloody margin was in there in the first place) ... but maybe wortt a try... just be ready to haggle haggle haggle!
PM me if you want any more info - I dont really want to name the builder on here incase it gets us in bother, as we havent moved in yet.
And chin up, think of all the horridness as just short term, and just something to be worked through to have a better quality of life very soon. I hope you'll be looking back in a few months in a better place.

I have no idea what this firm is like but a house near me has gone up for auction with them, they cover your area and seem to have fairly regular auctions (almost monthly)

Good Luck with selling and take advice on how to word the SPIF, dont incur costs untill the buyer has seen the SFIF, selling at auction wont take away the necessisity of filling out a SPIF, but they may not read it as throughly. A Carefully worded SPIF if thats possible can really help.Pawpurrs x0

What happened to the council/Police being able to legally evict someone who OWNS their own home for anti social behaviour?
If these neighbours have been reported in the papers and have been served ASBO's, etc, then why havent legal proceeding been started to evict them?
I know they have to be really bad to be evicted but would this not warrant it seeing as the OP has had to move away from their house, or did the OP cause the trouble in the first place?(just throwing a spanner in the works)
