    The homeless legislation does not discriminate against owner/occupioers. The same rules apply regardless of your tenure.


    Exactly, that's what I meant! She could maybe get out of the terrible situation very quickly. :)

    Well, I think she MAY have a strong argument regarding fleeing violence. BUT, as I understand it, she is also currently renting a place so the "Are you homeless" hurdle may be difficult to jump. There is the matter of "affordability", which may mitigate this, but it's certainly not clear cut.

    The other side of the homelessness issue is, of course, how the Local Authority would discharge any "duty to house", even assuming this would be accepted.

    Proxy bidding, one offer policy and the use of a wider catchment area than the applicant may like are all factors which make the homeless route an often brutal method of re-housing.

    By all means, this may be something worthwhile for the OP to look into, even as nothing more than a safety net. But in practice, it may not be the solution she seeks.

    I think, without wishing to sound harsh or unsympathetic towards what must be an awful position to be in, that the OP needs to decide what it is she wants/has to do next. THAT will be the difficult bit. But, once that decision is made, what is required to carry it out becomes much clearer.

    Hi All..

    Sorry there havent been any updates. Well we are currently going through the motions... have made all arrangements for auction in a few months, so that last resort is put in place. Have agreed fee etc with EA and they have agreed they are ok about auction if they do not find a buyer within our deadline...

    I have looked into all part ex within a 10 mile radius and nothing even suitable so far :-(...

    Wee Willy, the way it stands is we can no longer finance a house and rent. Our savings are gone therefore our only choices are- get rid of house asap, move back, homeless

    thanks for the update... at least you are taking control of things and that has to be good

    could you not ask your Lender for a mortgage holiday for a short time, or go on "interest only " for a few months.. this latter option may reduce your outgoings if they will not agree a full "holiday"

    An awfull position to be in, through no fault of your own, but it sound like you have almost made that choice. As I say, the decision is the difficult bit. Everything else just follows it.

    I wish you every happiness, whatever that decision may be.

    Thank you We Willy for your kind words and yes the decision has certainly been the hardest part


    Clutton, we are already interest only :-((( we have a few payment holidays we can take actually... oops forgot about that!!!! However i know that a payment holiday is not really a payment break but will add a sum onto the end of our mortgage which will quickly eat into what little equity we have... but could be a worthwhile thing to give us an extra month or two

    Hi I have read though most of the thread but skimmed the middle.

    We had a similar situation back in 95 and after one final traumatic event (which I could never write about) the next day, I went to a local EA and just said ''sell it''. No explanations, nothing however, nothing about neighbour disputes had to be declared back then plus the neighbour concerned was not directly next door.

    The quick sale price came back as same as our mortage plus 2k but we had spent 25k odd on renovations....and we had falling values in the early 90's.
    It sold the next day and we moved on after 4 months(which turned out to be a very good financial decision after a few years...but felt totally gutting at the time as we were 'hounded out').

    I also hasd to pull my son out his school too and the pain and angst back then..if I concentrate, I can still remember it....then we had a court case which cost us 2k which we couldn't afford but won in the end.

    Have you had an EA in yet?....I may have missed the post.....or put into auction taking on board what they say could be achievable, you may have to take on a loan to pay any shortfall......but i totally understand.
    I am a fighter and am never intimidated but the peope that caused us massive trauma...we had to leave and move on. The financial loss was recouped a few years later...in fact, it was very life changing.

    The 'cut your losses' arguement is a hard one but for the safety of your children, it may be the only option.

    Its over guys, we sold the house and handed over the keys yesterday




    I am in utter shock, overwhelmingly happy and cant believe we have finally reached that point where we can move on with our lives. Thank you so so so much for all the amazing support I have received and the non judgemental advice you have all offered.

    Im sorry I have not updated previously but I just couldnt bear jinxing the sale...


    God I am in need of a holiday.... I may be poor but I am bloody HAPPY.... cheapy to lazarote it may be
