Why not ask for a review and a new assessment will be carried out? you might find he declares it. It might just be that he has started making more since his last assessment was done and he didnt phone them up and ask for a new assessment, he doesnt actually have to.
When dealing with the CSA its important to note that it is commonly accepted as unfit for purpose, and by default this also means the staff are unfit for purpose.

it's a new claim, only been in place for a few weeks so I know he's not declared it and in fact he has admitted that he knows he's not paying as much to the children as he should, so can I just ring them and tell them about it? how will they look into it because neither he nor his employer are obviously going to admitt it.

I really think you should report it.

    Just give as much evidence as you have, ie financial records, video survellance etc etc;

You could try to get the CSA to do something about this, but from personal experience I doubt very much that they will.

I tried (without success) to prove that my ex was working for cash in hand over a period of about 5 years. I gave the CSA his employer's name, business address, home address, his times and places of work and the names of his workmates. I even offered to pay for a private detective to take photos. The CSA told me that this information wasn't enough as it only proved he was working and because he was paid cash they couldn't prove how much he was being paid. They even said that he might be working for nothing - just as a hobby!

The only other thing you could do is to let the Inland Revenue know about this 'job'. It might not help you get any maintenance but if they investigate he will either have to stop working or go legit so it might be worth a try.

    Good luck.
  • Yes you nail him right into the ground! You get him!

Poor bloke just trying to earn a bit extra for himself, that would never do would it given that in many cases your left with naff all to live on once this shower have took there chunk,im sure many on here could relate to this.

You already said he`s paying through the CSA,so whats the problem?
Why not go round and rip the shirt off his back while your at it!

Poor bloke just trying to earn a bit extra for himself,!

and that is the key bit - sod his kids basically

I hope the 'poor bloke' also refuses to take advantage of the things that the rest of us taxpayers pay for on his behalf.

He might only be paying a pittance and not a worthwhile contribution towards the children's upbringing. Children are expensive and often the amount contributed by the NRP falls a long way short of covering half of that expense.

In addition, it's actually illegal to work cash in hand without declaring it to the relevant authorities.

Thanks for you helpful imput Dissillusioned,
I do not want to take the shirt from his back, all I would like is for him to pay what he leagally should towards the upbringing of his children, the reason I asked the question in the first place is because I wanted to know if there was a way he could be made to pay what he should without involving the Inland Revenue as I don't want to get him or his employer into trouble.

Times are hard right now, what's wrong with earning some extra cash to pay his bills?

I'm with Dissilusioned, there are PWCs that get absolutely nothing, you are not one of them.
As some others have suggested, apply for a re-assesment if you wish, however the csa work from payslips and if the extra is not shown on his payslip, they can't really assess him on that, yes indded there are other sanctions, lifestyle inconsistent with income blah blah blah.
Let's just hope he does not do like some NRPs and just pay and go
