    Can I just remind you all gently that this is not a general discussion thread? The OP was asking if she could get a reassessment on the basis he was working for cash in hand - the answer to that is, you can but the onus of proof lies on you not him.

    The PWC is just trying to get what she is legally entitled to not take the shirt from his back. None of you know how much she is currently neing paid, it could be at a flat rate of £5 a week and the cash in hand could make the assessment £25 a week, a considerable difference to the PWC.

    Everyone is entitled to their opinion but I will not have flaming on the boards nor it turning into a general free for all.

    The extra earnings is not legal earnings, so therefore technically it is not available for assesment. As mentioned on other threads and in this post, the PWC can apply for re-assesment, there is nowhere this thread can go but off topic and into a discussion, as the real answers are available everywhere.
    Posters are never going to see eye to eye on this topic.
    We don't know the NRPs situation either as chances are he won't be eligible for housing benifts or CTC or WTC, so his only options maybe to do as he is or go onto benefits where then he pays just £5 pw and gets help with other stuff from the state.
    At the end of the day, no child has lost their life through lack of child support from the NRP.
    Sometimes it's best to just let sleeping dogs lay.

    If he is working cash in hand there is sod all the CSA can do about it, it's a police issue.

    It's just the same as a single mum on benefits cutting their friends hair for £20 or so and not declaring it. I know quite a few girls do this and can make quite a bit, £100-150pw or so cash in hand. No-one bats an eye lid, but because the shoe is on the other foot now and you want more money from him then all hell breaks loose.

    Move on and stop being so bitter and jealous.

    I cant believe some of these replies!! Why would the OP be jealous of someone committing fraud? I cant believe there are people actually condoning this behaviour and suggesting that its ok because people are struggling, times are hard or because someone is a single parent!! !!!!!!!!!

    I feel your pain OP. A friend of mine had(s) a rather messy split going on with her ex - he is the most unreasonable and horrible person going around. Anyway, he got voluntary redundancy from his job to the tune of around £13-15,000. My friend did not get a penny from this - as he was split up with her at the time of going through.

    He is driving a taxi now, and he gives the grand total of £5 per week, (when he bothers to pay it).

    Now, if you were truly on the breadline and not able to pay anymore, then that's fair enough...............but, this one can afford to go on holiday, get tattoos all over his body, drink to excess (yes, he is a taxi driver and drinks lots), and take his bit on the side out all the time. So, I think that he can afford more than a fiver to help pay for his child.

    Before anyone gets on their soapbox, I do realise that everyone's circumstances are different and that this person may be totally different from other people - this is my friend's experience but I happen to think that it is unfair.

    To answer your actual question, my friend has given all the relevent details to the CSA, but she has also been told that she needs to prove that he is working more than he says he is - nigh on impossible. They did acknowledge that he had this redundancy money, but reminded her that the wee one was not entitled to any of it.

    technically he is commiting fraud, happened to me with PWC, i reported nowt got done about it, might not help you get a higher assessment but go for it anyway, he should be paying the correct amount, regardless of anything else

    Inland Revenue Services carry more power than the CSA, so could well leave the NRP paying less due to higher tax :o

    No one bats an eyelid? I read this forum regularly and I see PWCs asked not to deny their NRP access by both NRPs and PWC, I see male PWCs asking for advice and being given advice by both NRPs and PWCs, I see NRPs asking about issues re maintenance and being given advice by both NRPs and PWCs. Unfortunately I see a small number of posters who are almost invariable men make posts such as yourselves. These posters rarely offer help to the female PWC and are much more likely to make snide remarks about them on a regular basis such as both of your posts in this thread. If it's a male PWC they are often told how biased it is here even though previous and subsequent posts show that that is not the case.

    I refer you to this post I made on another board as an example of how at least some of us are able to not automatically side with our own sex. I look forward to seeing some maturity from those who cannot perhaps in the next few years.
