She is avoiding all contact by telephone, in person & text but she did email me to say that "she's really sorry, her head is done in with all this, she's got no money, she'll get in trouble if she tells police she lied (perverting justice etc), telling them won't get me my car back so what's the point, if she could go back in time she would but she can't...." & thats about it really, no reply to any emails I've sent her since then & although 22yrs is a long time, I think the friendship can't continue mainly due to the way she's been since it happened, avoiding me, not offering to help buy me a new car, cover costs for breakyard etc. Her b/f's not even had to guts to contact me to say sorry, they're both just hiding from me!

That is pitiful behaviour from your friend, and as for the BF he should man up and do the honourable thing.

Hopefully you can appeal to her better nature, and if that fails perhaps there is some legal recourse you could take against her. Maybe others more well informed posters could advise if this is feasible.

You have in writing her admitting to lying to the police. You need to make sure that you have saved that email & take hard copies, take one to the police station & speak to a Senior Officer and report the whole incident. Now that you have evidence of her lying you could be an accessory to a crime.
If they went through any town centres he will be on CCTV. The Police can obviously get copies of the tape.
If the BF is already banned from driving the police should be prosecuting. As he has commited a criminal offence.
Speak to a solicitor, you can usually have a half hour free session, take a copy there.
It sounds that they were very lucky that the only thing damaged was the car & what they hit.
Obviously him being banned hasn't taught him that he's an incompetent driver, if he isn't punished properly this time, then next time it could be a family he wipes out with his arrogance & total disregard for others.
I'm assuming that you're all fairly young.
Tell your Mum, she probably will be cross that you lent the car, however most parents will just be very glad that nobody was seriously injured. At the end of the day, yes, it's a lot of money but it was just the car.
I can't offer any advice on getting any money back but the bf needs to be prosecuted & I do think that you have to do everything you can to ensure that happens.

Another thing to add to the list of problems coming your way (sorry) is the fact that if any road furniture (signs, armco barriers, kerbstones, lamp posts) were damaged in this accident the local council will be looking for someone to foot the bill for repairing them.

They will start with the registered owner.

Not true. She said she had insurance to drive other cars, 3rd party only probably.

The "friends" 3rd party cover will pay out for those. As long as she sticks to her story she was driving. If she changes that to her BF was driving then they should pursue him for the costs.

Your friendship is already lost, she !!!!!! on you from a great height.

You need to do what's best for you, the friendship is over, she made sure of that!

How many other times has her boyfriend driven your car without your knowledge?

Whenever instances on the Police Camera Action type programmes pop up where a car is not insured in it's own right, and the person has their own insurance policy on another car which covers them to drive other cars, the police believe this is against the law and are often shown seizing cars etc. Remember to be used on the road a car must be insured (they ask for evidence when buying road tax).

I believe only traders policies let you drive any car. Otherwise we'd all buy 1 litre fiestas with fully comp insurance, then get a Ferrari or Lamborghini and consider ourselves insured, which obviously isn't the way car insurance works.

Or a more likely scenario where a 18 year old lad buys a 1 litre corsa and insures it, then buys a £2k subaru impreza turbo with long tax and test on it.As he wouldn't be able to insure it for less than an arm and a leg he registers it in his dads name and noone insures it.Then he could drive it about safe in the knowledge he is covered.Or the 25 year old drink driver just out of his ban etc etc.

I too have seen people on Traffic Cops etc where the car is seized in circumstances such as these and the drivers look they are talking complete boll**ks when they try and justify it.

Edited to add: I have complete symathy with the OP and my posts are purely that you make sure you cannot get yourself into trouble for what this unscrupulous pair have done.I really think the BF should be prosecuted for what he's done.

As I recall they are prosecuting her for leaving scene of accident & driving without due care & attention, can't think of anything else they said they'd prosicute her for...BUT they did say that they would be in touch on Tues (accident happened last Fri night-30th April) & neither of us have heard a word from the police since, they didn't arrest her, didn't bail her & didn't ask her (or me) to produce doc's etc & she hasn't got to go to our local police station???

Never thought of that & I have emails in my inbox on msn & facebook (she sent through facebook but i get emails to my msn 1st).

As for my mum, well finally plucked up courage to tell her today (over the phone before 1 of my sons told her) & she was actually really good about it & to my biggest surprise (once she'd calmed down) said...its only a car!!! Surprised isn't the word for it, proud is getting nearer to the word :D

Unfortunately the bill from Blackpool Borough Council arrived today, £1723.45...it beggars belief that they act quicker than the police!!!
