No can can advise you whether you should admit/dispute/deny the debt, it has to be your decision, however, should you admit the debt, but dispute the amount, by default a CCJ will be registered against you, as stated, if paid within 28 days of judgement, it won't show on your credit file, once paid in full outside this period it will show as "satisfied"
You'll find further assistance on CCJs here
thanks for getting back to me, i mean if you were in my position what would you do? as i stated before i can afford to pay it off in 2 months making 2 payments on the 24th. that's the best i can do.. it was stupid of me to say i could pay it off in one because it leaves me with 0 money after DD go out of my account +300 overdrawn0 -
Hi
if you admit the claim and they refuse to accept your offer of two payments, you get a CCJ automatically. if you can be absolutely sure you can pay it off within 28 days of the CCJ, then OK.
If there is any chance you might struggle to pay (something breaks down, off sick etc) it may be better to defend the case. if you wait until the 14 days is nearly up to acknowledge, you have 28 days from then to summit the defence.
If you defend the case, get the case moved local, you will have paid it off by the time it gets to court.
You are the person who knows when you get paid etc.
hi i went with your advice and decided to use the acknowledgment of service and defend the claim..
lol i don't know why i did it but i think it would give me enough time by the time i went to court to save the money up to pay them off... i filled it out online...0 -

hi, i got a letter from this bryan carter and co claiming i owe them money from a company called Lowell finance, there saying its from an Abbey national bank account i had in 2003 i have heard nothing from this company or the bank until early this year, i had a joint account with my ex partner but i never used it after 2003 as we sold our house and both had 17,000 put in seperate accounts and i assumed this one was closed, i rang BC and asked for proof of this so called debt but all the stupid women from the solicitors on the end would say is make a payment make a payment, but i completly refused to make a payment for a debt i know nothing about and they can't give me any proof off she said to me i could pay 900 pound before a certain date i said i'd pay nothing until she had proof of my debt, i went to the CAB and they said not to talk to them they had no evidence i owed this and after 6 years its statuet barred, i even applied to experian and there is no live debt on there from any company, on friday i got court papers and i have no idea what to do is there anyone that can help me??? im so worried i've never had debt, i'm a student nurse and i don't know how anyone can take me to court for money i don't even know that i owe
any information would be gratefully recieved 0 -
