HELP there taking me to court!!

    If a CCJ is registered against you, you'll have difficulty trying to obtain credit for 6 years from date entered.

    Do not ignore the claim, you must acknowledge the claim within 14 days, you then have a choice to either admit / dispute / deny the claim, it's your choice what you decide to do, if you admit the claim, you'll have 28 days from date entered to pay the judgement “in full” to prevent a CCJ being awarded against you, should you admit the debt, but are unable to pay in full within 28 days, a CCJ will be registered against you.

    well to save the hassle i owe the money so im planning to admit the amout is £936 im planning to offer to pay it off with in 2 months with installments of 468.. will i still get a ccj? thanks for your reply mate.

    Hi

    if you admit the claim and they refuse to accept your offer of two payments, you get a CCJ automatically. if you can be absolutely sure you can pay it off within 28 days of the CCJ, then OK.

    If there is any chance you might struggle to pay (something breaks down, off sick etc) it may be better to defend the case. if you wait until the 14 days is nearly up to acknowledge, you have 28 days from then to summit the defence.

    If you defend the case, get the case moved local, you will have paid it off by the time it gets to court.

    You are the person who knows when you get paid etc.

    well the only way i can clear this is to pay this off in 2 parts i get paid the 24th of each month so my best bet would to be file a defense ? do i actually have to go to court?

    Re going to court, the court date is liekyl to be months away, so you would have apid it off before that happens.

  • i didnt think companys could take you to court besides government debts ie council tax and utillities? thats what they said at citizens advice they havnt got a leg to stand on?

    so really i have to wait a while just before 14 days say 12 fill it out to file for defense.. i could come up with the money this month but i have nothing for the month to live on after the DD go out of my account.. i will struggle.... anyway i would prefer to pay in 2 months half one month and half the other... i get paid on the 24th of each month... will the defense allow me enough time? what would i do? just turn up to court or would i have to pay for a solicitor? should i be worried because im so unsure on whats going on i can't focus on anything else but this...

    also the case will be months away? how does that work?
